The City Council of the City of New Brighton hereby amends City Code, Chapter 17, 128 <br />Article 3, Junked Vehicles, to adopt a clear civil process for the removal of junk and 129 <br />abandoned vehicles as follows: 130 <br />Sec. 17-49. Storage Restricted. 131 <br />No person shall store or keep an abandoned or junk vehicle (as those terms are defined in 132 <br />Minnesota Statutes, Section 168B.011), a wrecked vehicle or an inoperable vehicle on 133 <br />private property without a special use permit granted by the City Council unless such 134 <br />vehicle is stored in a fully enclosed garage. Vehicles not in conformity with Minnesota 135 <br />motor vehicle statutes regulating equipment, registration and insurance for operation on a 136 <br />street or highway, shall not be stored or kept on private property for more than 30 days 137 <br />without a special use permit unless such vehicle is stored in a fully enclosed garage. 138 <br />Sec. 17-50. Special Use Permit. 139 <br />(1) A special use permit may be issued for the storage of a junked motor vehicle only in 140 <br />accordance with the provisions of the Zoning Code. Issuance of the permit shall require 141 <br />conformance with all sections regarding zoning, set-backs, special use permit 142 <br />procedures, and fees. 143 <br />(2) In addition to the general special use permit standards required by zoning, the following 144 <br />standards must also be met: 145 <br />(A) The vehicle must be screened from view by surrounding properties; 146 <br />(B) The vehicle must be on a hard surface, or the applicant must show how any fluids 147 <br />will be prevented from entering the ground if the proposed storage location is on 148 <br />permeable land. 149 <br />(C) A specific end date for the proposed storage shall be established, but may be 150 <br />administratively extended by written request if no complaints about the storage 151 <br />have been received during the effective dates of the special use permit. 152 <br />Sec. 17-51. Current License Plates. 153 <br />Any vehicle shall be deemed to be included in Section 17-49 if it does not have attached a 154 <br />valid and current license plate issued by the proper State agency. The presence of a license 155 <br />plate shall not be the sole factor in determining the status of the vehicle. 156 <br />Sec. 17-52. Nuisance Declared. 157 <br />Each violation of the provisions of this Article is declared to be a nuisance affecting the 158 <br />public peace, safety, and general welfare. 159
