Page 6 of 11 <br /> <br /> <br /> <br />Sec. 17-53. Complaints. 160 <br />The Public Safety Department shall investigate all complaints. If after investigation there 161 <br />appears to be a violation of this Article, the Investigating Officer shall be authorized to sign 162 <br />a complaint. 163 <br />17-52. Impounding of vehicles. 164 <br />The city may take into custody and impound any abandoned, unlicensed, or junk vehicles 165 <br />that are being stored or parked in violation of this section. 166 <br />17-53. Notice and appeal option. 167 <br />Before taking into custody and impounding an abandoned, unlicensed, or junk vehicle, the 168 <br />Code Compliance Officer must give ten (10) calendar days mailed written notice to the 169 <br />owner of or person in control of the property on which the vehicle is located. The notice 170 <br />must include: 171 <br />(1) A description of the vehicle; 172 <br />(2) Notification that the vehicle must be removed or properly stored within ten days of the 173 <br />date of the notice; 174 <br />(3) Notification that if the vehicle is not removed or properly stored as ordered, the vehicle 175 <br />will be towed and impounded at an identified location; 176 <br />(4) An explanation that the vehicle may be reclaimed within fifteen (15) days of being 177 <br />towed and upon payment of all towing and storage charges and in accordance with the 178 <br />procedures contained in Minnesota Statues Section 168B.07, or it will be disposed of in 179 <br />accordance with Minnesota Statutes Section 168B.08; and 180 <br />(5) A notice that prior to the date that the vehicle is to be towed by the city, the owner of 181 <br />the vehicle or the owner of or person in control of the property on which the vehicle is 182 <br />located may appeal the order, in writing, to the City Council. 183 <br />(A) No further action on the towing and impoundment of the vehicle may be taken 184 <br />until the City Council concludes its review of the appeal; 185 <br />(B) The City Council shall act on a timely written request at its next regularly 186 <br />scheduled meeting or subsequent meeting. 187 <br />(C) The City Council shall affirm, modify, or reverse the decision in writing, and shall 188 <br />adopt specific findings of fact supporting the reasonableness of the decision. 189
