The City Council of the City of New Brighton hereby amends City Code, Chapter 27 192 <br />as follows: 193 <br />OPTION 1 (comprehensive option) 194 <br />*Repealed Ordinance No. 779 6-9-2009 195 <br />SWIMMING POOLS 196 <br />Sec. 27-1. Definitions. 197 <br />For the purposes of this chapter, the following words and phrases shall have the meanings 198 <br />respectively ascribed to them: 199 <br />(1) Swimming Pool: A structure, whether above or below grade level, designed to hold 200 <br />water more than 30 inches deep to be used for recreational purposes. Hot Tubs or 201 <br />similar uses are considered swimming pools. 202 <br />Sec. 27-2. Minimum Swimming Pool Standards. 203 <br />(1) General Requirements. 204 <br />Pools (including swimming pools, hot tubs, spas, and fountains) shall: 205 <br />(A) Not be connected directly to storm drains or the sanitary sewer system; 206 <br />(B) Be drained to designated landscaped areas adequate to contain and infiltrate the 207 <br />water. 208 <br />(2) Above Ground Swimming Pools 209 <br />(A) The maximum height for an above ground swimming pool is eight (8) feet 210 <br />measured from the average ground level to the top of the pool railing. 211 <br />(B) The maximum height for pool equipment shall be five (5) feet above the proposed 212 <br />grade. 213 <br />(C) All pool equipment shall be located in an inconspicuous location and be screened 214 <br />from adjacent property. 215
