Page 8 of 11 <br /> <br /> <br /> <br />(D) All above-ground swimming pools shall adhere to the following safety standards: 216 <br />(i) The pool shall be equipped with an automatically retractable type ladder, a 217 <br />retractable ladder, a removable ladder, or shall be fenced in accordance with 218 <br />the requirements for a below-ground swimming pool as outlined in Section 219 <br />27-2(2)(D)(i). 220 <br />(ii) If a ladder is used for safety purposes, the ladder must be removed or retracted 221 <br />when the pool is not being attended. 222 <br />(iii) If access to the pool is via a deck or porch, then no access from the ground is 223 <br />permitted to the deck area unless the property or the ground access to the deck 224 <br />is fenced in accordance with the requirements for a below-ground swimming 225 <br />pool as outlined in in Section 27-2(2)(D)(i). 226 <br />(E) It shall be the responsibility of the property owner to maintain all implemented 227 <br />safety devices in good operating condition. Failure to maintain safety devices, 228 <br />fences, failure to have gates closed or failure to remove or retract the ladder 229 <br />access to the pool when unattended shall constitute a violation of this Ordinance. 230 <br />(3) Below Ground Swimming Pools 231 <br />(A) The maximum height for a below ground swimming pool is one (1) foot above the 232 <br />proposed grade. 233 <br />(B) The maximum height for pool equipment shall be five (5) feet above the proposed 234 <br />grade. 235 <br />(C) All pool equipment shall be located in an inconspicuous location and be screened 236 <br />from adjacent property. 237 <br />(D) All below ground swimming pools shall include one of the following safety 238 <br />barriers: 239 <br />(i) Safety fence 240 <br />The swimming pool shall be completely enclosed by a non-climbable type 241 <br />fence. All fence openings or points of entry into the pool area shall be 242 <br />equipped with gates. The fence and gates shall be at least four (4) feet in 243 <br />height and shall be constructed of a minimum number eleven gauge woven 244 <br />wire mesh corrosion-resistant material or other material approved by the 245 <br />building official. All gates shall be equipped with self-closing and self-246 <br />latching devices placed at the top of the gate or otherwise be inaccessible to 247 <br />small children. All fence posts shall be decay or corrosion resistant and shall 248 <br />be set in concrete bases or other suitable protection.
