Fences shall be identified on the survey or site plan submitted 251 <br />with the building permit application. 252 <br />(ii) Automatic (powered) safety pool cover 253 <br />Automatic pool covers shall meet the standards of F1346-91 of the American 254 <br />Society of Testing and Materials (ASTM), as such standards may be modified, 255 <br />superseded or replaced by ASTM. Manually assembled or positioned safety 256 <br />pool covers shall not suffice as a required pool barrier. It shall be the 257 <br />responsibility of the building permit applicant and property owner to submit 258 <br />materials ensuring compliance with the ASTM standards for an automatic 259 <br />pool cover prior to the issuance of a building permit. Compliance with the 260 <br />ASTM standards shall be shown with the building permit application for the 261 <br />pool. 262 <br />(E) It shall be the responsibility of the property owner to maintain all pool covers, 263 <br />fences, gates and closure devices in good operating condition. Failure to maintain 264 <br />pool covers, fences, or failure to have gates closed shall constitute a violation of 265 <br />this Ordinance. 266 <br />OPTION 2 (minimal approach option – IPMC Option) 267 <br />*Repealed Ordinance No. 779 6-9-2009 268 <br />SWIMMING POOLS 269 <br />Sec. 27-1. Definitions. 270 <br />For the purposes of this chapter, the following words and phrases shall have the meanings 271 <br />respectively ascribed to them: 272 <br />(1) Swimming Pool: A structure, whether above or below grade level, designed to hold 273 <br />water more than 30 inches deep to be used for recreational purposes. Hot Tubs or 274 <br />similar uses are considered swimming pools. 275 <br />Sec. 27-2. Minimum Swimming Pool Standards. 276 <br />(1) General Requirements. 277 <br />Swimming pools shall be maintained in a clean and sanitary condition, and in good 278 <br />repair. 279
