Page 10 of 11 <br /> <br /> <br /> <br />(2) Enclosures. 280 <br />(A) Private swimming pools, hot tubs and spas, containing water more than 24 inches 281 <br />(610 mm) in depth shall be completely surrounded by a fence or barrier at least 48 282 <br />inches (1219 mm) in height above the finished ground level measured on the side 283 <br />of the barrier away from the pool. Gates and doors in such barriers shall be self-284 <br />closing and self-latching. Where the self-latching device is a minimum of 54 285 <br />inches (1372 mm) above the bottom of the gate, the release mechanism shall be 286 <br />located on the pool side of the gate. Self-closing and self-latching gates shall be 287 <br />maintained such that the gate will positively close and latch when released from 288 <br />an open position of 6 inches (152 mm) from the gatepost. No existing pool 289 <br />enclosure shall be removed, replaced, or changed in a manner that reduces its 290 <br />effectiveness as a safety barrier. 291 <br />(B) Exception. Spas or hot tubs with a safety cover that complies with ASTM F 1346 292 <br />(as may be amended) shall be exempt from the provisions of 27-2(2)(A). 293 <br />Section 7. The City Council of the City of New Brighton hereby amends City Code, Chapter 11 294 <br />Garbage and Trash, as follows: 295 <br />Sections 11-1 through 11-7 are restated and incorporated herein unchanged. 296 <br />Sec. 11-8. Placement of Containers. 297 <br />(1) Garbage, rubbish, recycling, and yard waste containers shall be: 298 <br />(A) Placed in the rear or on the side of the premises, or if a corner lot, placed in the 299 <br />rear or non-road fronting side of the premises; OR 300 <br />(B) Placed in such a manner as to be out of view from the street (or streets) from in 301 <br />front fronting of the premises, or OR 302 <br />(C) Placed in a garage located on the premises.; and 303 <br />(D) Placed in a location for collection after 5:00pm on the day before the day of 304 <br />collection and removed before 8:00pm on the day of collection. (Ordinance No. 305 <br />802, June 28, 2011) 306 <br />(2) Containers shall not be placed or maintained in such a way as to unreasonably interfere 307 <br />with the use of adjoining property. 308 <br />(3) Containers shall be placed in such a manner as to prevent entry of or harborage for 309 <br />animals, insects, or other vermin. Containers shall be maintained so as not to be tipped 310 <br />over. 311
