Page 1 of 3 <br /> <br />RESOLUTION <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />AUTHORIZING A STORAGE CONTAINER & CARGO CONTAINER BUSINESS THAT <br />RENTS, SELLS AND STORES NEW AND USED PORTABLE STORAGE CONTAINERS <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, Larry Tyson owns the property located at 401 1st Street SW legally described as: <br />That part of the North Half of the South Half of the Northeast Quarter of the <br />Northeast Quarter of Section 32, Township 30, Range 23, lying westerly of <br />Interstate Highway 35W and lying Easterly of the Minnesota Belt Line <br />Railroad, Ramsey County, Minnesota. <br /> <br />WHEREAS, Larry Tyson and Bill Kirkpatrick (the “Applicants”) made application to the City on <br />7/19/19 for a Special Use Permit (SUP) to authorize a moving storage container & cargo container <br />business that rents, sells and stores new and used portable storage containers; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission at their meeting on August 20th, 2019; and <br /> <br />WHEREAS, the Planning Commission held a public hearing on the request at the August 20th <br />meeting and considered input from residents; and <br /> <br />WHEREAS, the Planning Commission recommended approval of the request on August 20th, 2019, <br />based on the applicant’s submittals and findings of fact; and <br /> <br />WHEREAS, the City Council considered on August 27th, 2019, the recommendations of the <br />Planning Commission, Staff, the Applicant's submissions, the contents of the staff report, and other <br />evidence available to the Council. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested special use permit based on the following findings of fact: <br />1. The proposed outdoor storage will not be detrimental to the public health or general welfare <br />provided all materials are stored per an approved plan;
