Given existing <br />vegetation on the periphery of the site, this appears to be a win-win/workable way <br />forward. <br /> <br />Lighting: Lighting on all sites and buildings shall be directed downward and installed so as <br />to prevent direct light from being detectable at the lot line of the site on which the <br />light source is located. Lighting is also not to shine directly into the public right- <br />of-way. <br /> While no new lighting is currently proposed for this new use, any plans to add <br />lighting to the yard or building will need to adhere to minimum code requirements. <br /> <br /> Lot Access: The main access point to the property is off New Brighton Road in the NE corner <br />of the property. No additional/new access is proposed, and the site plan provides <br />for controlled access and screening at the access point. <br /> As previously noted, current parcel data suggests that an alleyway from the south <br />nearly bisects this property to the northern property line (see the site map on pg 2). <br />− The previous warehouse use approval in 2008 denotes this area as “vacated <br />alley.” <br />− The applicant’s updated survey indicates “alley status unknown.” <br />This issue must be addressed in one or more of the following ways: <br />− The applicant should be required to have their surveyor do all necessary due <br />diligence to indicate the current status of the alleyway on the updated survey. <br />• If vacated, the City presumably reserved ROW to a specific spot near the <br />lift station. That area shall be protected via mechanisms agreed to with <br />Public works. <br />• If NOT vacated, the applicant shall initiate a request for the City to vacate <br />any unnecessary portion of the alley, <br />OR <br />Enter into an encroachment agreement with the City to allow access to the <br />easement. If the applicant seeks the vacation and it is not approved, an <br />encroachment agreement must be signed for the SUP and site plan to <br />remain valid. <br /> <br /> <br />
