B) RECOMMEND DENIAL OF THE REQUESTS based on the applicant’s <br />submittals and findings of fact. <br />C) TABLE THE ITEMS and request additional information. <br />Based on a complete application date of 2/14/20, the standard deadline for a <br />decision on these requests (60 days) would be 4/14/20. Due to the COVID-19 <br />outbreak and cancellation of meetings, the deadline was extended an additional <br />60-days out to 6/13/20. As the state has taken no action to suspend the 60-day <br />rule, a decision must be made by the 6/13/20 deadline. <br /> <br />Template Denial <br />Motion: <br />(not recommended) <br /> “I move that we deny the requested SUP and Site Plan Amendments and the <br />requested variance based on the following findings of fact:” <br />o (provide findings to support your conclusion) <br /> <br />Template Approval <br />Motion: <br />RECOMMENDED <br /> “I move that we approve the requested SUP and Site Plan Amendments and <br />the requested variance based on the findings of fact on page 11 of the report, <br />and subject to the conditions listed on pages 11 & 12 as may have been <br />amended here tonight. <br /> <br />Suggested Findings <br />of Fact: <br />1. No changes in use are proposed at this time, and no new impacts will be <br />created for surrounding properties as a result of the proposed changes. <br />2. The plans as submitted successfully show that a private or public roadway <br />could be accommodated through the chimney of the lot to service the <br />properties. <br />3. No road will be constructed at this time. <br />4. Future development of Lot 2 will trigger the need to implement a final <br />solution to lot access, so final road design and placement will be addressed <br />at that time. <br />5. Lot 1 currently has full frontage on a nonconforming 30’ wide roadway <br />easement, and would have access to Old Highway 8 via the proposed Outlot <br />A. <br /> <br />Recommended <br />Conditions: <br /> <br /> <br />1. Prior to the City signing the final plat and authorizing it for filing at the <br />County, the applicant shall dedicate an easement over the storm water pipe <br />and lake outlet extending northward from Rush Lake as directed by the City <br />Engineer.
