Ordinance to Establish Temporary Use Regulations <br />Planning Commission Review; 5-19-20 <br /> <br /> <br /> <br /> <br />Page 2 <br /> Subsection (3), Overlap with Other Code Provisions, lines 28 – 41. Acknowledges that there may be times <br />where identified temporary uses may overlap with Specially Permitted Uses in code, or may allow for uses that <br />would otherwise be prohibited by code. <br /> Subsection (4), Temporary Use Permits, lines 42 – 126. Outlines the process a landowner must go through to <br />obtain a temporary use permit addressing everything from what needs to be in the application, to how it will <br />be reviewed, what the effect of an approval means, how long the temporary use can run, how the City will deal <br />with amendments, and what happens if a permit must be revoked. <br />DRAFT RESOLUTION ESTABLISHING TEMPORARY USES <br /> Along with the Draft of Ordinance 874, staff also prepared a draft resolution establishing temporary uses for <br />2020. All such uses and specific conditions for each are outlined in Exhibit A. <br /> At the present time, staff would be proposing that at a minimum, “Outdoor Dining in Conjunction with a <br />Licensed Food Establishment” be established to address the anticipated applications the City could see in the <br />coming weeks from multiple restaurants. Beyond that, we are also recommending six other uses at this time: <br />o Construction dumpsters – already a temporary use within the City, but our code regulations are <br />currently vague and out-of-step with the process we actually follow. This would address that <br />problem. <br />o Construction trailer – in researching this ordinance, staff discovered that construction trailers are <br />allowed by one section of code (16-75) while they are prohibited by another section of code (7-82). <br />Identifying them as a temporary use will solve the problem, and will provide time to fix the existing <br />code contradiction. <br />o Real Estate Office / Model Sales Home – not well defined in our current code, but not something the <br />City has historically frowned upon. As we’d expect such units in Midtown Village, we are suggesting <br />being proactive and identifying the use now. <br />o Temporary Signs – called out to provide us with leeway for signage in and around Outdoor Dining <br />areas <br />o Temporary Storage in a Portable Container – currently allowed under City Code section 17-2(8). <br />Inclusion here allows staff to establish at least some minimal conditions for such units that currently <br />do not exist in code. <br />o Use of Mobile Homes, Trailers, Campers, etc – including this provision here would formalize the <br />process to approve the temporary use of mobile homes and campers which is allowed under City Code <br />Section 16-75 via a “temporary special permit.”
