The City Council of New Brighton hereby amends Zoning Code Chapter 8; Article 1 General 9 <br />Conditions; as follows: 10 <br />Sections 8-010 through 8-063 are restated and incorporated herein unchanged, and the following 11 <br />language is added. 12 <br /> 13 <br />Sec. 8-064. Temporary Uses. 14 <br />(1) Purpose 15 <br />The provisions of this Code cannot reasonably include all possible temporary uses which may 16 <br />be appropriate in various areas of the City, and the need for which may change very quickly 17 <br />due to unforeseen circumstances such as natural disasters or pandemics. This section allows 18 <br />for the establishment of certain temporary uses for a limited duration. Temporary uses shall 19 <br />not involve the construction or alteration of any permanent building or structure. 20 <br />(2) Establishment of Temporary Uses 21 <br />Temporary uses in the City of New Brighton shall be identified and established by the City 22 <br />Council via resolution on a yearly basis. When establishing specific temporary uses allowed 23 <br />within the City, Council may identify the use as being allowed outright provided certain 24 <br />conditions are met, or they may require an administrative temporary use permit be acquired 25 <br />through the Department of Community Assets and Development before the temporary use is 26 <br />established. 27 <br />(3) Overlap with Other Code Provisions 28 <br />(A) Specially Permitted Uses 29 <br />Uses authorized for approval as a temporary use by Council may overlap with uses 30 <br />identified as Specially Permitted within the zoning ordinance. In such cases, a 31 <br />landowner may choose to pursue a temporary use permit to authorize the use for a 32 <br />limited timeframe as may be allowed by Council, or may pursue a Special Use Permit 33 <br />to secure permanent approval of the use. 34
