SUP Review: Big Blue Box & A Tree Service Planning Commission Report; 6-16-20 Page 10 Special Use Permit Review In General:  The need for a Special Use Permit is triggered by the new outdoor storage uses and the need to ensure such storage not pose a danger to the public or the adjacent drainage ditch moving forward. SUP Standards Review: Issuance of an SUP requires an analysis of the proposed use against the specific review criteria established in code. Staff has reviewed the City’s criteria for special use permits, and we offer the following analysis for consideration: General review Criteria (Section 8-130): 1. That the establishment, maintenance, or operation of the special use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare. Applicant Comment: The existing business A Tree Service has been renting and operating on this site for almost a year and has recently purchased the property. There intent is to conduct business in New Brighton far into the future. Previous and current operation has not been detrimental to the city or the public as it is located in an industrial zone. Staff Comment: It should be noted that both applicants were very aware of the need to obtain an SUP to authorize both of the proposed outdoor storage uses on this site, so the noted operation of A Tree Service from the site for “almost a year” is disappointing to discover. On the positive side of things, the use went un- noticed and did not generate any complaints suggesting the City can expect the same moving forward. On the negative side, actions of the applicant suggest a Laissez-faire attitude towards local regulations, so adding specific conditions to any approval that must be adhered to is advised.. Big Blue Box did attempt to utilize the site for storage without approval last January, but the City did receive a complaint and the use was required to be terminated in early February. No further use of the land for container storage has happened since that time. Given the plans now before the City and based on feedback received to date, staff’s main concerns with this application are as follows: a) (Public Safety) Storage of all wood materials must be adequately contained to prevent any inadvertent deposit of materials into the adjacent drainage ditch. As noted in the site plan review, the applicants should come to agreement with DCAD staff on a final containment solution that can/will be effective over the long-term. Additional perimeter control around all stockpiles will be required.
