SUP Review: Big Blue Box & A Tree Service <br />Planning Commission Report; 6-16-20 <br /> <br /> <br />Page 10 <br />Special Use Permit Review <br />In General:  The need for a Special Use Permit is triggered by the new outdoor storage uses and <br />the need to ensure such storage not pose a danger to the public or the adjacent <br />drainage ditch moving forward. <br /> <br />SUP Standards <br />Review: <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Issuance of an SUP requires an analysis of the proposed use against the specific review <br />criteria established in code. Staff has reviewed the City’s criteria for special use <br />permits, and we offer the following analysis for consideration: <br /> <br />General review Criteria (Section 8-130): <br />1. That the establishment, maintenance, or operation of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general <br />welfare. <br />Applicant Comment: The existing business A Tree Service has been renting and <br />operating on this site for almost a year and has recently purchased the property. <br />There intent is to conduct business in New Brighton far into the future. Previous <br />and current operation has not been detrimental to the city or the public as it is <br />located in an industrial zone. <br /> <br />Staff Comment: It should be noted that both applicants were very aware of the <br />need to obtain an SUP to authorize both of the proposed outdoor storage uses on <br />this site, so the noted operation of A Tree Service from the site for “almost a year” <br />is disappointing to discover. On the positive side of things, the use went un- <br />noticed and did not generate any complaints suggesting the City can expect the <br />same moving forward. On the negative side, actions of the applicant suggest a <br />Laissez-faire attitude towards local regulations, so adding specific conditions to <br />any approval that must be adhered to is advised.. <br />Big Blue Box did attempt to utilize the site for storage without approval last <br />January, but the City did receive a complaint and the use was required to be <br />terminated in early February. No further use of the land for container storage has <br />happened since that time. <br />Given the plans now before the City and based on feedback received to date, <br />staff’s main concerns with this application are as follows: <br /> <br />a) (Public Safety) Storage of all wood materials must be adequately contained to <br />prevent any inadvertent deposit of materials into the adjacent drainage ditch. <br />As noted in the site plan review, the applicants should come to agreement with <br />DCAD staff on a final containment solution that can/will be effective over the <br />long-term. Additional perimeter control around all stockpiles will be required.
