Variance Request – WilsonWolf (2100 Old Highway 8) <br />Planning Commission Report; 8-18-20 <br /> <br /> <br />Page 9 <br />Engineering <br />Review: <br /> Engineering reviewed the proposed plans for the addition and had no comments or <br />concerns. <br /> <br />Public Safety <br />Review: <br /> No comments or concerns. <br /> <br />Public <br />Comment: <br /> The neighboring property owner to the north recognizes there may be a conflict <br />between the patio and their future roadway to the north. If it will not impact their <br />future roadway, they would not have an issue with the proposal. Staff has indicated <br />to the neighbor that construction of the patio would definitely be factored into the <br />future engineering of the roadway, and it may increase costs. <br /> <br />Staff Rec: Denial of the requested 15-foot side yard variance to allow for construction of <br />the proposed patio. <br /> If the applicant is willing to amend the application to request only a sidewalk within <br />the setback to connect to a conforming patio east of the building, staff would <br />recommend approval of that request subject to conditions. <br /> <br /> <br />Conclusion: <br /> The applicant is requesting a 15-foot variance from the required 15’ side yard <br />setback to construct a patio for use by employees. <br />Staff Recommendation: Per the analysis and findings outlined in the report, <br />staff is recommending DENIAL of the request. <br /> <br />Commission <br />Options: <br />The Planning Commission has the following options: <br />A) RECOMMEND APPROVAL OF THE REQUEST based on the <br />applicant’s submittals and findings of fact. <br />B) RECOMMEND DENIAL OF THE REQUEST based on the applicant’s <br />submittals and findings of fact. <br />C) TABLE THE ITEM and request additional information. <br />Based on an application date of 7/24/20, the 60-day review period for this <br />application expires on 9/22/20. This deadline can be extended an additional 60 <br />days if more time is necessary.
