Ordinance to Establish Interim Permitted Use Regulations <br />Planning Commission Review; 9-15-20 <br /> <br /> <br /> <br /> <br />Page 2 <br /> Section 2: Placing the Interim Use Tool within the Zoning Ordinance <br /> Lines 22 - 31. Establishes the purpose and intent of the interim use permit tool. Interim uses can be <br />established to achieve one of three goals: <br />o to allow a use briefly while a permanent location is obtained or finishes construction, OR <br />o to allow something that is presently acceptable, but will not be acceptable in the future or will be <br />replaced with something conforming to code; OR <br />o to allow pre-development of a long-range goal called out in the Comprehensive Plan <br /> Lines 72 - 117. Outlines how an IUP application will be reviewed. Subsection (1) established nine criteria <br />under which applications must be analyzed. <br /> Lines 97 – 106. Outlines the Planning Commission review process (same process as variances and SUPs). <br /> Lines 107 – 117. Outlines the City Council review process (same process as variances and SUPs). <br /> Lines 118 – 121. States that the City may impose reasonable conditions when granting approval of any IUP. <br /> Lines 122 – 127. States that approval of an IUP only grants approval to the improvements and use <br />authorized by Council over the specified timeframe, and clarifies that approval runs with the land unless <br />ownership change is the trigger terminating the interim use. <br /> Lines 128 – 132. States that approval of an IUP does not guarantee further required approvals such as a <br />building permit. <br /> Lines 133 – 140. Outlines four standards under which IUPs are terminated (whichever occurs first): <br />o The date, event, or circumstance listed on the permit, OR <br />o Upon violation of permit conditions, OR <br />o Upon a change to zoning which renders the use nonconforming, OR <br />o Upon redevelopment of the property (or area) to a permitted or conditionally permitted state <br /> Lines 141 – 152. Revocation language provided by our City Attorney. <br /> Lines 153 – 155. Identifies what process must be used if an applicant wishes to amend an approved IUP. <br /> Lines 156 – 169. Identifies what process must be used if an applicant wishes to renew an IUP that is set to <br />expire. <br /> Lines 170 – 171. Reserves remaining numbers, and maintains all further language in Chapter 8 unchanged.
