That the applicant, owner, operator, tenant and/or user has no entitlement to future re-63 <br />approval of the interim use permit; 64 <br />B. That the interim use will not impose additional costs on the public if it is necessary for 65 <br />the public to fully or partially take the property in the future; and 66 <br />C. That the applicant, owner, operator, tenant and/or user will abide by conditions of 67 <br />approval that the City Council attaches to the interim use permit. 68 <br />(8) Any other information that may be reasonably required by the City to evaluate the 69 <br />application. 70 <br />Sec. 8-150. Review. 71 <br />(1) Interim Use Review Criteria. Approval of an interim use permit requires that the City find 72 <br />that conditions (if needed) can be established to ensure all of the following criteria will 73 <br />always be met: 74 <br />A. The use is allowed as an interim use in the respective zoning district and conforms to 75 <br />standard zoning regulations unless exempted by the specific interim use type; 76 <br />B. The use will not adversely affect nearby properties through nuisance, noise, traffic, dust, 77 <br />odor, or unsightliness; and will not otherwise adversely affect the health, safety, and 78 <br />welfare of the community; 79 <br />C. The use will not adversely impact implementation of the Comprehensive Plan; 80 <br />D. The date, event, or change in circumstances that will terminate the use is identified with 81 <br />certainty; 82 <br />E. The applicant has signed a consent agreement stating that the applicant, owner, operator, 83 <br />tenant and/or user has no entitlement to future re-approval of the interim use permit as 84 <br />well as agreeing that the interim use will not impose additional costs on the public if it is 85 <br />necessary for the public to fully or partially take the property in the future; 86 <br />F. The applicant agrees to all conditions that the City Council deems appropriate to allow 87 <br />the interim use including, but not limited to, the requirement of appropriate financial 88 <br />surety to cover the cost of removing the interim use and any interim structures upon the 89 <br />expiration of the interim use permit; 90 <br />G. There are no delinquent property taxes, special assessments, or City utility charges due 91 <br />upon the subject parcel; 92 <br />H. The interim use will adhere to any applicable additional criteria for the use required in the 93 <br />applicable zoning district; and 94 <br />I. The term of the interim use does not exceed two years unless an end date for the use is 95 <br />attached to a specific triggering event. 96
