Page 1 of 4 <br /> <br />RESOLUTION NO. _____ <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A HEIGHT VARIANCE TO <br />AUTHORIZE CONSTRUCTION OF A CONFORMING SIZED DYNAMIC ELECTRONIC <br />GROUND SIGN AT 388 CLEVELAND AVENUE <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, Lauris Valtinson (the “Applicant”) is owner of property at 388 Cleveland Avenue SW <br />which has the property identification number of xx-xx-xx-xx-xxxx and is legally described as: <br /> <br /><insert legal description here> <br /> <br />and <br /> <br />WHEREAS, the Applicant’s property is guided by the Comprehensive Plan for Commercial use, <br />and is zoned B-1 on the City’s official zoning map; and <br /> <br />WHEREAS, business signs in the B-1 district must be 10-feet from property lines abutting roads, <br />not exceed 25 feet in height, and not exceed 36 square feet in area; and <br /> <br />WHEREAS, in 2003, the city mistakenly permitted a 40 square foot wall sign which, because it is <br />only visible from a freeway, should not have been permitted as Freeway signs were not allowed in <br />the B-1 district in 2003; and <br /> <br />WHEREAS, the sign is considered legal nonconforming; and <br /> <br />WHEREAS, in 2020, MnDOT began construction of a sound wall on I-35W that will block view of <br />the legal nonconforming wall sign from the freeway; and <br /> <br /> <br /> <br />
