Special Use Permit – Applewood Pointe <br />Planning Commission Report; 11-17-20 <br /> <br /> <br />Page 5 <br />Special Use Permit Review <br />In General: The need for a Special Use Permit is triggered by the request to build the fence <br />over 6-feet in height. <br /> <br />Criteria Review: <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Zoning Code Section 8-130 contains five standards the City must review prior to making <br />a decision on any specially permitted use. The applicant’s response to each criteria can <br />be found in their narrative above, and staff analysis of each standard is shown below: <br />1. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general <br />welfare. <br />APPLICANT COMMENTS: The new fence will not affect any of the above. An 8 foot fence height <br />will screen the adjacent industrial building’s drive, loading, and materials storage areas more <br />effectively from the view of the Cooperative residents and will have no affect on the general <br />public or welfare. <br />Staff Analysis: Staff agrees with the applicant’s assessment. The new fence will <br />fulfill its intended purpose, and poses no concern to general public welfare. Criteria <br />met. <br /> <br />2. That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />APPLICANT COMMENTS: There is no other property than Johnson Screens in the immediate <br />vicinity that will have a direct view of the new fence. The fence stars approximately 290 feet <br />from the east property line along Old Highway 8 and runs further west 80 feet. The office <br />building to the east of our site may have a partial view of the fence but it will also screen their <br />view of the Johnson Screen activity and storage areas. <br />Staff Analysis: The proposed fence will have no impact on the adjacent use, nor <br />will it impair area property values. Criteria met. <br /> <br />3. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in <br />the district. <br />APPLICANT COMMENTS: The property is the area is fully developed and the new fence should <br />have no affect on surrounding property development or improvement. <br />Staff Analysis: As stated by the applicant, the proposed fence will have no impact <br />on how Johnson Screens can use their property. Criteria met. <br />
