That adequate utilities, access roads, drainage and/or necessary facilities have <br />been or are being provided. <br />APPLICANT COMMENTS: All of the above already exist and no modifications to any will be <br />made. The new fence will have no affect on drainage as no grading will be involved. <br />Staff Analysis: There are no access or utility issues at question with this application. <br />Criteria met. <br />5. That the special use shall in all other respects conform to the applicable <br />regulations of the district in which it is located. <br />APPLICANT COMMENTS: The new fence will conform to the applicable regulations of the <br />District in all respects. The additional 2 feet of fence height is the unique characteristic of this <br />submittal. <br />Staff Analysis: With the exception of height, the fence will conform to all other <br />code standards. Criteria met. <br /> <br />In addition to the five standard SUP Criteria, special purpose fences must also meet the <br />following three additional standards per section 4-540(3)(F): <br />6. The fence is necessary to protect and buffer the premises for which such fences <br />are intended; <br />Staff Analysis: The set of facts for this application seems to be exactly why code <br />provides flexibility for fences via a special use permit. The additional height will <br />have no impact on the adjacent property, but will provide a significant improvement <br />to aesthetics on the applicant’s property. Criteria met. <br />7. The fence will not be deleterious to adjacent property nor to the general public <br />health, safety, or welfare; <br />Staff Analysis: The author of this additional standard for fences must have <br />forgotten the City’s general SUP review criteria already address these questions. <br />Luckily, since reviewing the general criteria only minutes ago, we’ve found no <br />reason to believe we erred in our earlier analysis! Criteria (still) met. <br /> <br /> <br />
