Special Use Permit – Applewood Pointe <br />Planning Commission Report; 11-17-20 <br /> <br /> <br />Page 7 <br />(cont.) 8. Would be consistent with the intent and purpose of the fence regulations as stated <br />in Section 4-540(1) of the Zoning Code. <br />Staff Analysis: The intent outlined in code is to “ensure orderly development,” and <br />to “allow a free flow of air, and prohibit unreasonable restrictions of view while <br />allowing each property owner an opportunity for privacy, property protection, and <br />the ability to make reasonable use of the property.” The proposed fence does not <br />run the entire property line, and is clearly proposed to provide privacy and aesthetic <br />improvements to the subject property. Staff does believe the proposal is compliant <br />with the City’s fence regulations. Criteria met. <br /> <br /> <br />Supplementary Review & Public Comment <br />Additional <br />Information: <br /> none <br /> <br />Engineering <br />Review: <br /> Engineering had no comment or issue with the proposed fence. <br /> <br />Public Safety <br />Review: <br /> No concerns were identified. <br /> <br />Public <br />Comment: <br /> Staff has not received any feedback from surrounding property owners as of <br />11/11/20. <br /> <br /> <br />Conclusion: <br /> The application is requesting a Special Use Permit to authorize to authorize <br />construction of a fence in excess of six (6) feet for a limited run to provide greater <br />privacy to this residential development <br />Staff Recommendation: Per the analysis outlined in the report, staff is <br />recommending APPROVAL with conditions <br /> <br /> <br /> <br /> <br /> <br />
