Special Use Permit – Applewood Pointe <br />Planning Commission Report; 11-17-20 <br /> <br /> <br />Page 8 <br />Commission <br />Options: <br />The Planning Commission has the following options: <br />A) RECOMMEND APPROVAL OF THE REQUEST based on the <br />applicant’s submittals and findings of fact. <br />B) RECOMMEND DENIAL OF THE REQUEST based on the applicant’s <br />submittals and findings of fact. <br />C) TABLE THE ITEM and request additional information. <br />Based on an application date of 10/9/20, the 60-day review period for this <br />application expires on 12/8/20. This deadline can be extended an additional 60 <br />days if more time is necessary. <br /> <br />Template Denial <br />Motion: <br />(not recommended) <br /> “I move that we recommend the City Council deny the requested special use <br />permit based on the following findings of fact:” <br />o (provide findings to support your conclusion) <br /> <br />Template Approval <br />Motion: <br />RECOMMENDED <br /> “I move we recommend the City Council approve the requested special use <br />based on the findings of fact and conditions listed on pages 8 and 9 of the <br />report as may have been amended here tonight.” <br /> <br />Suggested Findings <br />of Fact: <br />1. The subject property is guided for Mixed Use Regional Node by the <br />comprehensive plan, and multifamily buildings and fences are appropriate <br />given this designation. <br />2. Erection of the proposed fence will not be detrimental to or endanger the <br />public health, safety, morals, comfort, or general welfare of the community. <br />3. The proposed fence will have no impact on development of adjacent land. <br />4. The new fence will not create any access issues for either property, nor are <br />there concerns about its impact on City utilities. <br />5. The proposed fence will conform is all other respects to underlying zoning <br />requirements. <br />6. The applicant has demonstrated the fence is necessary to provide a buffer <br />between this residential use and the adjacent industrial use. <br />7. The purpose for the fence is consistent with the intent and purpose regulations <br />for fences spelled out in the New Brighton zoning ordinance.
