Page 1 of 3 <br /> <br />RESOLUTION NO. _____ <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />TO AUTHORIZE AN 8 FOOT TALL FENCE FOR THE APPLEWOOD POINTE RESIDENTIAL <br />COOPERATIVE AT 1900 RUSH LAKE TRAIL <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, James O’Brien on behalf of the Applewood Pointe Residential Cooperative (the <br />“Applicant”) made application to the City on 10/9/20 for a special use permit to authorize an 8-foot <br />tall fence at 1900 Rush Lake Trail which has the property identification number of 17-30-23-44- <br />0120; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission at their meeting on November 17, 2020; and <br /> <br />WHEREAS, the Planning Commission held a public hearing on the request at the November 17th <br />meeting and considered input from residents; and <br /> <br />WHEREAS, the Planning Commission recommended approval of the request on November 17th <br />based on the applicant’s submittals and findings of fact; and <br /> <br />WHEREAS, the City Council considered on November 24th, 2020, the recommendations of the <br />Planning Commission, Staff, the Applicant's submissions, the contents of the staff report, and other <br />evidence available to the Council. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested special use permit based on the following findings of fact: <br />1. The subject property is guided for Mixed Use Regional Node by the comprehensive plan, and <br />multifamily buildings and fences are appropriate given this designation. <br />2. Erection of the proposed fence will not be detrimental to or endanger the public health, <br />safety, morals, comfort, or general welfare of the community. <br /> <br />
