Page 1 of 3 RESOLUTION NO. _____ STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT TO AUTHORIZE AN 8 FOOT TALL FENCE FOR THE APPLEWOOD POINTE RESIDENTIAL COOPERATIVE AT 1900 RUSH LAKE TRAIL WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the laws of the State of Minnesota; and, WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan and corresponding zoning regulations to promote orderly development and utilization of land within the city; and, WHEREAS, James O’Brien on behalf of the Applewood Pointe Residential Cooperative (the “Applicant”) made application to the City on 10/9/20 for a special use permit to authorize an 8-foot tall fence at 1900 Rush Lake Trail which has the property identification number of 17-30-23-44- 0120; and WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning Commission at their meeting on November 17, 2020; and WHEREAS, the Planning Commission held a public hearing on the request at the November 17th meeting and considered input from residents; and WHEREAS, the Planning Commission recommended approval of the request on November 17th based on the applicant’s submittals and findings of fact; and WHEREAS, the City Council considered on November 24th, 2020, the recommendations of the Planning Commission, Staff, the Applicant's submissions, the contents of the staff report, and other evidence available to the Council. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton hereby approves the requested special use permit based on the following findings of fact: 1. The subject property is guided for Mixed Use Regional Node by the comprehensive plan, and multifamily buildings and fences are appropriate given this designation. 2. Erection of the proposed fence will not be detrimental to or endanger the public health, safety, morals, comfort, or general welfare of the community.
