The new fence will not create any access issues for either property, nor are there concerns <br />about its impact on City utilities. <br />5. The proposed fence will conform is all other respects to underlying zoning requirements. <br />6. The applicant has demonstrated the fence is necessary to provide a buffer between this <br />residential use and the adjacent industrial use. <br />7. The purpose for the fence is consistent with the intent and purpose regulations for fences <br />spelled out in the New Brighton zoning ordinance. <br /> <br />BE IT FURTHER RESOLVED, that approval of the special use permit shall be subject to the <br />following conditions: <br />1. The Special Use Permit shall authorize an 8-foot tall fence in accordance with the site plan <br />submitted and reviewed as part of this SUP. <br />2. Minor changes to the fence location and length may be administratively approved by staff, <br />but major adjustments (i.e. any increase in height or a length extension exceeding five feet) <br />shall only be authorized via an SUP amendment. <br />3. Failure to adhere to these conditions of approval shall be grounds for revocation of the <br />special use permit by the City Council.
