1 <br />625263v1KG400-1 <br />RESOLUTION NO. 20- <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />A RESOLUTION AUTHORIZING DIVISIONS OF VARIOUS PARCELS OF LAND TO <br />CORRECT OVERLAPS AND GAPS RELATED TO THE PARCEL OWNED BY <br />MURLOWSKI PROPERTIES, INC. <br /> <br />BE IT RESOLVED by the City Council of the City of New Brighton, Minnesota as follows: <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under <br />the laws of the State of Minnesota; and <br /> <br />WHEREAS, the City Council of the City of New Brighton has adopted subdivision regulations in <br />the Zoning Code to promote orderly development and utilization of land within the City; and <br /> <br />WHEREAS, Section 26-6 of the Zoning Code allows administrative approval of divisions of <br />parcels of land into one or more lots or parcels for the purpose of transfer of ownership so long as <br />the division does not constitute a “subdivision” under the Zoning Code; and <br /> <br />WHEREAS, Murlowski Properties, Inc., a Minnesota corporation (the “Applicant”) desires to <br />correct various overlaps and gaps concerning its property, which is legally described on the <br />attached Exhibit A (the “Applicant Property”); and <br /> <br />WHEREAS, the correction of these overlaps and gaps do not constitute a “subdivision” as defined <br />in Section 26-3 (20) of the Zoning Code as the parcels that are being divided are not being divided <br />into separate lots or parcels but are rather being attached to the adjacent parcels; and <br /> <br />WHEREAS, the Applicant has requested a land division to have the lot line shared by the <br />Applicant Property and the parcel to the north that is owned by Minnesota Cement Masons- <br />Plasterers, Shophands Journeymen and Apprentice Training Trust Fund (“MCMPSJATTF”) <br />adjusted where a portion of the Applicant Property is severed from the Applicant Property and <br />attached to the parcel owned by MCMPSJATTF as depicted and shown on the attached Exhibit B <br />(“Land Division #1”); and <br /> <br />WHEREAS, MCMPSJATTF has requested a land division to have the lot line shared by the parcel <br />owned by MCMPSJATTF and the Applicant Property adjusted where a portion of the <br />MCMPSJATTF parcel is severed from the MCMPSJATTF parcel and attached to the Applicant <br />Property as depicted and shown on the attached Exhibit C (“Land Division #2”); and <br /> <br />WHEREAS, likewise, the Applicant has requested a land division to have the lot line shared by <br />the Applicant and the parcel to the north that is owned by Murco, Inc, a Minnesota corporation <br />(“Murco”) adjusted where a portion of the Applicant Property is severed from the Applicant <br />Property and attached to the parcel owned by Murco as depicted and shown on the attached Exhibit <br />D (“Land Division #3”); and
