2 <br />625263v1KG400-1 <br />WHEREAS, the Applicant has submitted to the City certified surveys and legal descriptions of <br />the land divisions; and <br /> <br />WHEREAS, the City Council reviewed the requests on March 24, 2020; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of New Brighton <br />makes the following findings of fact: <br /> <br />1. That the minor subdivision and platting regulations of the City’s Zoning Code (i.e. <br />subdivision regulations) do not apply in this situation. <br /> <br />2. That the restrictions on the division of taxes and filing and recording are waived <br />because compliance would create an unnecessary undue hardship and failure to comply <br />does not interfere with the purpose of the City’s subdivision regulations. <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED, that the City Council of the City of <br />New Brighton hereby approves the land divisions as shown on the exhibits attached hereto with <br />the following conditions: <br /> <br />1. The Applicant shall be responsible for drafting, executing, and recording such transfer <br />documents and deeds as may be required to achieve the land divisions set forth in this <br />Resolution. All property transfer documents related to these land divisions, including the <br />deeds for the parcels, must be recorded with the County no later than 180 days from the <br />date of this Resolution. Copies of the recorded deeds must be provided to the City within <br />seven days of recording. Failure by the Applicant to record the deeds by the date indicated <br />in this Resolution will render the City’s approval of the land divisions null and void, unless <br />the City Council grants an extension. <br /> <br />2. The Applicant shall be responsible for contacting the Ramsey County Assessor’s office <br />and if required by the County, for supplying such information as may be needed to update <br />the legal descriptions associated with the tax identification numbers for the resulting <br />parcels. <br /> <br />3. The Applicant agrees to comply with all laws, ordinances, and regulations of the State, <br />County, and City applicable to the land divisions. The Applicant provided all of the legal <br />descriptions related to the land divisions and the City did not review them for accuracy, <br />completeness, or sufficiency for a particular purpose. If the legal descriptions or surveys <br />provided by the Applicant are determined by the County to not be sufficient for its <br />purposes, the Applicant shall be solely responsible for correcting or obtaining such <br />additional information as may be needed to resolve the insufficiencies. <br /> <br /> <br /> <br />
