Summary: Murlowski Properties Inc is seeking to clean up the legal descriptions of their <br />properties to facilitate a current sale of the Belair Building, and future <br />sale/redevelopment of the larger undeveloped parcel currently utilized <br />(primarily) for aggregate recycling. No new uses or changes to uses would be <br />authorized as a result of these applications. <br />Specific requests being considered as a single package for approval on <br />4/28/20 are as follows: <br />Preliminary & Final Plat – needed to authorize filing of the new plat which <br />amends legal descriptions to clean up gaps and overlaps with surrounding <br />properties…necessary to facilitate current and future property transfers. <br />Variance – needed as the new plan will maintain the existing <br />nonconforming 30’ right-of-way frontage for Lot 1, while providing for a <br />new potential accesss via Outlot A which does not fully front on Lot 1. <br />Site Plan Amendment – needed to document that Outlot A could be used <br />for roadway purposes in conjunction with future development. <br />SUP Amendment – needed to amend previous conditions of approval with <br />the following effects: <br />o Would allow chimney area of Lot 2 to be used for roadway purposes if <br />needed in the future. <br />o Future road construction through the chimney would need to protect <br />existing vegetation in as much as possible. <br />o A formal easement would need to be dedicated over the outlet for <br />Rush Lake. <br />o Outlet upgrades to occur when Lot 2 develops, or once grant funding is <br />secured to implement the change…final funding to be determined. <br />Both the Planning Commission and staff are recommending approval of all <br />requests. <br />Attachments: 1) Staff report <br />2)Applicant’s materials & narrative <br />3)Draft resolution <br />_______________________ <br />Ben Gozola, AICP <br />Assistant Director of Community Assets and Development
