Murlowski Industrial Park Preliminary & Final Plat, SUP & Site Plan Amendment, and Variance
City Council Report; 4-28-20

Page 14
Supplementary Review & Public Comment
Additional
Information:
 None

Engineering
Review:
 Given the lack of improvements proposed by this application, all Engineering
comments were simply incorporated into this memo, and no separate memo was
penned.

Public Safety
Review:
 No public safety concerns on this application.

Public
Comment:
 No comments have been received on these requests as of the packet completion date
(4/23/20).
 No speakers came forward during the public hearing on 4/21/20.

Planning
Commission &
Staff Recs.:
 The new plans address staff’s only concern with the proposed clean up of legal
descriptions: demonstrating that future access to Lot 1 is protected and available
regardless of ownership of either lot.
 Likewise, the solution being implemented by the applicants is an adequate substitute
for full roadway frontage on Lot 1, and therefore the requested variance is supported
by the City’s subdivision ordinance.
 Given the above, the Planning Commission and staff are recommending
conditional approval of all requests.

Conclusion:
This set of applications make up the technical/procedural process the applicants
must go through to clean up the legal descriptions for their properties. At this
time, the City’s only interests are protecting all options for access to the site by
current and future uses; and securing a formal easement for the existing outlet for
Rush Lake which is intended to be relocated in the future once plans for a new
outlet are established (likely figured out at the time of future development of Lot
2).
