As a condition of approval for the proposed preliminary and final plat, the <br />applicants were required to show access to the proposed Lot 2 could be <br />independently obtained through means other than the inadequate 30-foot wide <br />roadway easement. <br />9. The plans provided by the applicant in this application have been <br />acknowledged by all interested parties (Ramsey County, MnDOT, the <br />railroad, RCWD, etc) as being a realistic alternative to roadway access in the <br />future for Lot 2. <br />10. Previous conditions of approval for the SUP and Site Plan must be amended <br />to allow for this potential future roadway access. <br />11. No road will be designed or constructed until such time as the landowners <br />decide to move forward with development of Lot 2 <br />12. A variance to lot frontage for Lot 1 is justified as the plans clearly <br />demonstrate that adequate options exist to provide roadway access to all <br />proposed properties. <br />13. Lot 1 currently has full frontage on a nonconforming 30’ wide roadway <br />easement, and would also have access to Old Highway 8 via the proposed <br />Outlot A. <br />14. The special use will continue to conform with all provisions of the <br />Environmental Constraint Overlay Area by following all existing and <br />amended conditions of approval. <br />15. Future development of Lot 2 will trigger the need to implement a final <br />solution to lot access, so final road design and placement will be addressed at <br />that time. <br /> <br />Resolution <br />Conditions: <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />1. All previous conditions of approval applicable to this site, unless specifically <br />changed by this approval, shall remain in effect. <br />2. All previous conditions requiring the chimney portion of the property (Outlot <br />A) be kept in a natural state are hereby repealed, and the area may be utilized <br />for ingress/egress purposes. <br />3. Future construction/design of a road through Outlot A shall strive to preserve <br />existing vegetation on both sides of the railroad tracks in as much as possible. <br />4. The applicant shall dedicate an easement over the storm water pipe and lake <br />outlet extending northward from Rush Lake as directed by the City Engineer. <br /> <br />
