4.Comprehensive General Liability Insurance (including coverage for contractual <br />liability, products and completed operations liability, liabilities arising out of <br />explosion, or underground related incidents) with minimum combined single <br />limits of $1,000,000 per occurrence. In addition, the Comprehensive General <br />Liability policy shall include the Owner and the City as additional insureds with <br />respect to Work done on the Property. <br />(i)The City will notify the Owner of the contractors that will be performing the Work. The <br />Work will not commence until August 1, 2020 or later. <br />(j)The City will restore any areas on the Property impacted by the Work including <br />replacing topsoil, seeding, and fertilizing the impacted areas and establish and <br />maintain new turf for a period of 30 days. <br />(k)Permanent improvements on the property (such as but not limited to fencing, <br />sidewalk, and irrigation) that are impacted by construction will be restored to their <br />preconstruction condition by the City. <br />(l)In the event that trees must be removed to perform the Work, replacement trees equal <br />to the number of trees removed will be planted at a location within the Property as <br />determined by the Owner. <br />(m)The City will provide the Owner a written notice of completion once the City Parties <br />complete the Work. <br />3.Duties of Property Owner <br />(a)The Owner will allow the City access to the property for the purposes of performing <br />open cut excavation pits to facilitate trenchless sewer construction. <br />(b)The Owner waives any and all claims of unlawful takings or inverse condemnation <br />related to the Work performed by the City and or the City’s Parties. <br />(c)The Owner shall not interfere with the Work being performed by the City Parties. <br />4.Governing Law. This Agreement shall be interpreted in accordance with the laws of the state <br />of Minnesota.
