Page -7- <br />engaged in any activity in connection with the PROJECT to discriminate <br />against any employee or applicant for employment in connection with the <br />PROJECT because of age, marital status, race, creed, color, national <br />origin, or the presence of any sensory, mental or physical handicap, except <br />when there is a bona fide occupational limitation. <br />5.15. Construct the PROPERTY to meet all applicable local codes, <br />rehabilitation standards, ordinances and zoning ordinances. <br />5.16. Meet the historic preservation requirements of Public Law 89-665 and the <br />Archeological and Historic Preservation Act of 1974, Pub. L. 93-291 and <br />Executive Order 11593, including the procedures prescribed in the <br />Regulations at 36 CFR Part 800. <br />5.17. Comply with the design requirements of the Architectural Barriers Act of <br />1968, 42 U.S.C. §4151in construction of the improvements and the <br />Americans with Disabilities Act 42 U.S.C. § 12131. <br />5.18. Comply with the provisions of the Clean Air Act, as amended, 42 U.S.C. § <br />7401 et seq., and the Federal Water Pollution Control Act, amended, 33 <br />U.S.C. § 1251, et seq., and the regulations issued thereunder. <br />5.19. Comply with the HUD Lead-Based Paint Regulations, 24 CFR Part 35, <br />issued pursuant to the Lead-Based Paint Poisoning Prevention Act, 42 <br />U.S.C. § 4831 et seq., requiring prohibition of the use of lead-based paint; <br />elimination of immediate lead-based paint hazards in residential <br />structures; and notification of the hazards of lead-based paint poisoning to <br />purchasers and tenants or residents of structures constructed prior to 1978. <br />5.20. During construction, erect a sign to the AUTHORITY's specifications on <br />the PROPERTY identifying the AUTHORITY's Environmental Response <br />Fund Program as a source of funding for the PROJECT. <br />5.21. Comply with all applicable statutes, regulations, codes and ordinances <br />regulating the use or storage of Hazardous Substances which GRANTEE <br />stores on the PROPERTY. <br />5.22. Include in all news releases and public notices related to the PROJECT <br />information identifying the AUTHORITY's Environmental Response <br />Fund Program as a source of funds for the PROJECT. <br />5.23 Use the proceeds, which AUTHORITY is granting to GRANTEE solely <br />for remediation activities at the Former MicomCorp/TGLDC, LLC site in <br />the City of New Brighton. <br />5.24 Comply with all federal, state and local laws that apply to the construction
