Consider Resolution Approving a Site Plan and Nonconforming Use Variance for Jamatar II <br />LLC and Everest Properties LLC to reconfigure previously approved shared parking <br />arrangements. <br /> <br />Motion by Councilmember Jacobsen, seconded by Councilmember Allen to adopt a Resolution <br />approving a Site Plan Amendment and Nonconforming Use Variance to Authorize a Reconfiguration <br />of Parking between the Properties at 441 Old Highway 8, 750 4th Street NW and 755 4th Street NW <br />based on the findings of fact and conditions. <br /> <br />City Manager Massopust indicated Assistant Director of Community Assets and Development Gozola would <br />be presenting this item to the Council. <br />Assistant Director of Community Assets and Development Gozola stated this area of the City has <br />significant history dating back before our present zoning code resulting in multiple legal <br />nonconformities and an arrangement of uses that would not occur under present development <br />standards. The present property owners have determined that “fixes” put in place to address <br />parking issues over 20 years ago are not operating as intended, and are preventing efficient use <br />of the land in this area. The proposed site plan amendment and variance are needed to address <br />these long-standing problems. Staff commented further on the benefits of the proposed request <br />and explained the applicant has not provided staff with a turning movement study. It was <br />noted the Planning Commission reviewed this request and recommended approval based on the <br />findings of fact, conditions, and requiring the applicant to provide DCAD with a turning <br />movement study. <br />Mayor Johnson asked if the flooding of this property was being addressed through this request. <br />Assistant Director of Community Assets and Development Gozola explained the applicant has been working <br />with Director Schlichting to address the drainage and grading concerns. <br />Councilmember Fynewever thanked staff for their work on this request. She requested further information <br />regarding the safety of the parking spaces near the extension of the storage area. Assistant Director of <br />Community Assets and Development Gozola reported Stinson Electric would be fencing in this area as an <br />outdoor storage area and the parking would be shifted closer to the building. <br />Councilmember Allen inquired if a road would be extended through this area. Assistant Director of <br />Community Assets and Development Gozola indicated a road would not be extended through this area. <br />Councilmember Allen stated he supported this matter moving forward if the turning safety and drainage <br />issues are addressed with staff. <br />Councilmember Jacobsen concurred. <br /> <br />A roll call vote was taken. <br /> <br />5 Ayes, 0 Nays-Motion Carried <br /> <br />3.
