Ord 881: Manufactured Home Parks <br />Planning Commission Review; 4-20-21 <br /> <br /> <br /> <br /> <br />Page 2 <br />Section 1: Changes to City Code Chapter 16 <br /> Lines 14 – 55. Definitions. This portion of the ordinance updates or adds definitions to match current <br />statutory definitions for terms related to manufactured homes. Most references to the historical term “mobile <br />home” have been removed in favor of the term “manufactured home” throughout the ordinance. <br /> Lines 56 – 60. Administration. This language has been updated to indicate the Department of Community <br />Assets and Development will oversee administration of City Code Chapter 16. <br /> Lines 61 – 73. Conflicts. This language was updated to reflect the many levels of regulations that can and do <br />oversee manufactured homes, and as is currently the case, reflect that the more restrictive regulaton will always <br />apply in the event of conflicts. <br /> Lines 74 – 78. Variances. The no-longer-used term “unnecessary hardship” was removed. “Practical difficulty” <br />is currently the statutory test for whether or not a variance can be approved. <br /> Lines 79 – 84. Applicability. The existing applicability language is in reference to statutory limitations as to <br />how regulations can apply to manufactured home parks. As neither of the City’s manufactured home parks was <br />established prior to April 3, 1962, acknowledging that protection is unnecessary. To replace this language, we <br />are recommending language to clarify that Chapter 16 will apply to NEW manufactured home parks, or to <br />expansion areas of existing manufactured home parks. What happens internally within existing parks will be <br />handled by the underlying zoning district. This is how the City has historically implemented Chapter 16, so we <br />are simply codifying past practice with this change. <br /> Lines 90 – 126. Application. Language regarding what the City would like to see if/when a new area of <br />manufactured home park is proposed has been fully updated to comply with modern day standards and <br />expectations for plan submittals. <br /> Lines 127 – 130. [Deleted]. This language was removed as the City no longer requires applicants to provide <br />mailing labels for public hearing notifications. As we do for all other application types, we will use the latest <br />data provided by Ramsey County to generate needed mailing lists in-house <br /> Lines 131 – 134. Fee. This language was updated to indicate the required fee for this application will be as <br />established on a yearly basis by the City’s fee schedule. Eligibility for a refund will be subject to standard City <br />policy (i.e. if no work has been completed, a refund can be issued; if work is already underway or completed, no <br />refund will be issued).
