March 23, 2021 <br />Councilmember Dunsworth asked if there was any way to restrict events at a short term rental, such as a <br />wedding. Assistant Director of Community Assets and Development Gozola stated staff can give more <br />thought to that. He reported the intent of the occupancy limit was to address large gatherings. <br />Councilmember Dunsworth explained none of the Councilmembeis live by the problem house. She noted the <br />Council was trying to strike a balance and understood this property has been a concern to the neighbors. She <br />thanked the neighbors for coming forward and voicing their concerns. <br />Mayor Niedfeldt-Thomas questioned how many calls the City has received for this rental property, and or <br />other rental properties in the City. City Manager Massopust stated he had asked Public Safety to run the <br />numbers and stated from January 2019 to today there have been 15 police incidents at this property and no <br />calls to any other AirBNB's in the City. <br />Mayor Niedfeldt-Thomas reported it was her understanding, after checking websites, that there were four <br />other short term rentals being listed in New Brighton. She commented on how the City's lakes were a <br />community asset and the homes on these lakes could begin to host more events in the future. <br />Councilmember Allen thanked staff for their efforts on this Ordinance and for working to find a balance on <br />how to address short term rentals. He stated as the City moves forward, if problems were to arise, the Council <br />can revisit this Ordinance. He thanked all of the residents that came forward and expressed their concerns this <br />evening. <br />Councilmember Axberg explained her lake cabin was next to an AirBNB, so she understood the concerns. <br />She noted she has also been a renter of AirBNB's and worked to be a model renter. She thanked staff and the <br />Planning Commission for their efforts on this Ordinance. It was her hope this Ordinance would serve both <br />homeowners and renters in a balanced manner going forward. <br />Assistant Director of Community Assets and Development Gozola questioned who should be issuing the <br />permits. He stated as the Ordinance stands, the City Council would be approving the permits on the Consent <br />Agenda. He noted this could be changed to staff if this was the desire of the Council. <br />Councilmember Abdulle inquired how staff believed this should be managed. Assistant Director of <br />Community Assets and Development Gozola stated he believed it would be better to have staff administer the <br />permits with staff giving the Council a report on the permits issued. <br />Councilmember Abdulle supported this recommendation. <br />Councilmember Allen agreed. <br />Councilmember Dunsworth asked if staff would be able to present the Council with permit requests if there <br />was a concern. Assistant Director of Community Assets and Development Gozola discussed the information <br />that would have to be provided on a permit application. He explained if staff were to deny a request, the <br />applicant would appeal to the City Council. <br />3. Consider Resolution Ordering Project 21-1, 2021 Street Rehabilitation. <br />Motion by Councilmember Allen, seconded by Councilmember Axberg to open the <br />Public Hearing. <br />A roll call vote was taken. <br />5 Ayes, 0 Nays - Motion Carried <br />The Public Hearing was opened at 8:32 p.m. <br />City Manager Massopust indicated Director of Community Assets and Development Schlichting would be <br />presenting this item to the Council. <br />Director of Community Assets and Development Schlichting stated the purpose of this item is to hold the <br />Public Improvement Hearing for proposed Project 21-1, 2021 Street Rehabilitation. The <br />Feasibility Study discussed at length. Staff described in detail the improvements that would be <br />completed on the streets included in the project area noting the project was estimated to cost <br />$2.89 million.
