He wanted to learn more about how Dominium was working to ensure these violations <br /> - 1 don't occur in the future. <br /> Councilmember Dunsworth commented she believed this was a bit preemptive as the City did not know who <br /> Dominium would be hiring as its subcontractors. She questioned if Dominium had to submit a list of <br /> subcontractors to the City. Lotter reported this was not required. He anticipated Dominium would have a hard <br /> time keeping their license if they continued to use questionable subcontractors. <br /> Councilmember Jacobsen stated he believed the City had good safe guards in place to ensure high quality work <br /> would be completed. He indicated he was comfortable with the project going forward. <br /> Councilmember Burg thanked Councilmember Allen for being thorough and investigating this further. <br /> Councilmember Dunsworth believed it was unfair to hold one developer to a higher standard than another. She <br /> thanked Councilmember Allen for making the Council aware of Dominium's history. It was her hope that <br /> Dominium would be completing better checks on their subcontractors going forward. <br /> Mayor Johnson commented it was not the City Council's role to monitor this project. Rather, she stated there <br /> were City guidelines in place that would assist in overseeing the construction and inspection of this <br /> redevelopment project. She explained if Dominium was hiring people that are not living up to proper <br /> standards, this was a Dominium problem and the State or City inspectors will find this. She indicated she did <br /> not want to see the City overstepping on this matter as it could set a precedent for future redevelopment <br /> projects. <br /> 1 <br /> Lotter explained there was an accountability structure in place that was already established noting it may not be <br /> the City's place to govern this issue. He reported the Development Agreement would have boilerplate <br /> language requiring both Dominium and Pulte to follow all City and State laws. <br /> Mayor Johnson expressed concern that Councilmember Allen was bringing his personal work into the work of <br /> the City Council. She stated she did not want the New Brighton City Council to be known as the Council that <br /> has a union watchdog. She explained she appreciated Councilmember Allen raising his concerns but stated <br /> this may not be the appropriate vetting process. <br /> Councilmember Allen commented at the end of the day he wanted to know if Dominium was going to be using <br /> certain subcontractors and if so, they would need to watch more closely based on past grievances. <br /> Lotter asked if the Council would object to Ben Gozola speaking with a representative from Dominium asking <br /> if they were aware of the three contractors and their history. <br /> Mayor Johnson indicated she had a problem with this. She recommended Lotter speak with the City Attorney <br /> regarding this matter. She feared that the City would be putting Dominium in a position where they would lose <br /> business and now the City was liable. <br /> Councilmember Dunsworth explained she was uncertain if the City has required other developers to provide a <br /> list of subcontractors in the past. She indicated she had a problem with singling out these three subcontractors <br /> or the one developer. She stated she just did not want to see the City overstepping. However, she commented <br /> it may benefit the City to have a list of subcontractors that would be working in New Brighton. <br /> Councilmember Allen stated he supported this recommendation. <br />
