investigation found that the Applicant has eleven reported names and three dates of birth <br /> that he uses. <br /> 3. The Applicant has failed to provide information that is required on the application which <br /> is grounds for denial of the license pursuant to Section 15-59 (D) of the City Code. The <br /> name of the applicant's business is "TEE's Tobacco." Per the supplemental background <br /> application form and Minnesota Statutes Section 333.01, subdivision 1,the Applicant is to <br /> file a certificate of assumed name with the Minnesota Secretary of State for the business. <br /> The Applicant did not file this information with the Secretary of State. It was also <br /> determined by the City that TEE's Tobacco has not been registered with the Secretary of <br /> State as a business entity. <br /> 4. The Applicant has provided misleading information on the application which is grounds <br /> for denial of the license pursuant to Section 15-59 (D)of the City Code. The supplemental <br /> background application form requires the Applicant to list"all convictions for any felony, <br /> crime, or ordinance violation"(with the exception of any traffic ordinance violations). The <br /> Applicant did not list any violations on the supplemental background application form. <br /> The City's background investigation found that the Applicant has four felony convictions, <br /> one gross misdemeanor conviction, and 20 driving after withdrawal convictions, none of <br /> which were disclosed by the Applicant. <br /> 5. The Applicant has failed to provide information that is required on the application which <br /> is grounds for denial of the license pursuant to Section 15-59 (D) of the City Code. <br /> Minnesota Statutes Section 270C.72, subdivision 4 requires businesses who make taxable <br /> sales or businesses that are required to file or pay MinnesotaCare taxes or special taxes <br /> when they are in the business of selling items such as alcohol or tobacco register for a <br /> Minnesota tax identification number.
