Metropolitan Council No. 20I008 <br /> CONSTRUCTION COOPERATION AGREEMENT FOR <br /> CONSTRUCTION OF CURED IN-PLACE PIPE <br /> IN NEW BRIGHTON, MN <br /> THIS AGREEMENT is made and entered into by and between the Metropolitan <br /> Council, a public corporation and political subdivision of the State of Minnesota("Council"), and <br /> the City of New Brighton, a municipal corporation under the laws of the State of Minnesota <br /> ("City"). <br /> BACKGROUND RECITALS <br /> 1. The Council plans to rehabilitate Interceptor 8451 between manholes 2 and 43 and <br /> Interceptor 2-NB-100 between manholes 43 and 41 by installing cured in-place pipe liners and <br /> fiberglass manhole inserts, during the 2021 construction season("the Council Project"). <br /> 2. To avoid additional disruption to the community, the City desires to rehabilitate its <br /> 18"x29" CMP sanitary sewer from manhole 44 to the connection to the Council's manhole 43 as <br /> referenced on the City's record plan of Project Number ("the City Project"). <br /> 3. Both Council and City desire that the City Project be constructed in conjunction <br /> with the Council Project to minimize community impacts. <br /> 4. The City is not staffed or equipped to construct the City Project during the 2021 <br /> construction season. <br /> 5. Therefore, the City desires to have the Council construct the City Project <br /> contemporaneously with the Council Project. <br /> NOW, THEREFORE, for mutual consideration, the receipt and sufficiency of which is <br /> hereby acknowledged by the parties, the parties agree as follows: <br /> AGREEMENT <br /> I. Purpose of Agreement <br /> 1. This Agreement describes the responsibilities of each of the Parties for design and <br /> construction of the City Project. <br /> 2. The City appoints the Council as its agent to obtain bids, enter into a contract for <br /> the construction of the work, and supervise the work performed on the City Project for <br /> compliance with the City Project construction documents and this Agreement. <br /> 3. The scope of the City Project is: Rehabilitate 262 lineal feet of 18-inch x 29-inch <br /> Page 1 of 14 <br />
