October 12,2021 Page 3 of 9 <br /> A resident living on 478 Ninth Avenue NW,explained she lives right across from the restaurant.She reported <br /> she was concerned with the rubbish left on the site and noted the property looks like a dump. She <br /> recommended the site be cleaned up.She also understood the music was loud in the summer. <br /> Kelly Clapper,436 Ninth Avenue NW,reported she lived directly behind the Mirage. She indicated this <br /> property was disgusting. She commented there were people hiding behind the building and maintenance of <br /> the building was extremely poor.She encouraged the City to revoke this SUP in order to bring this property <br /> into compliance. <br /> Pedro Rother,490 Ninth Avenue NW,stated he lived slightly north of the Mirage. He indicated the music <br /> and bass coming from this business was a concern to him.He explained he does not like calling Public Safety <br /> but understood they have responded to the neighbors concerns.He commented he could support this business <br /> continuing to operate if they could control the sound. He stated this business was adjacent to homes and this <br /> business was no longer cognizant of this. <br /> Danny Doms,675 Fourth Avenue,commented he was speaking on behalf of his father who lived near the <br /> Mirage. He noted the grass on this property during the summer time was very long.He indicated this <br /> property had become a dump and he encouraged the City to take action. <br /> Fulli Cooker,Mirage representative,explained he began running this business in 2018.He noted he <br /> approached the City at that time and received guidance as far as what needs to be done.He commented he has <br /> engaged himself with a landlord that has not been good to people in the community and this was affecting <br /> him now.He indicated he has invested a great deal of money into the property and he would like to make <br /> things better.He stated the trash was the responsibility of the landlord but he was having to do this task <br /> because the landlord was not completing this task.He indicated he wanted to improve the property and the <br /> surrounding community.He explained whatever it takes,he was willing to do it in order to keep his business <br /> operational.He understood there has been noise complaints and he was working to get this under control.He <br /> stated he would also ensure that the rear door of the building was shut to keep the noise internal. <br /> Greg Amosu,Mirage representative,stated he has been a resident of New Brighton for the past 27 years.He <br /> discussed how he has been working with the City and Officer Hamdorf to bring this property into <br /> compliance. He requested the City give him and his partner a second chance. <br /> Mayor Niedfeldt-Thomas asked for additional comments, there were none. <br /> Motion by Councilmember Dunsworth, seconded by Councilmember Axberg to close the <br /> Public Hearing. <br /> 5 Ayes,0 Nays-Motion Carried <br /> The Public Hearing was closed at 7:12 p.m. <br /> Councilmember Allen commented he lives relatively close to the Mirage.He noted on occasion he has <br /> noticed loud,late parties.He understood this has been a problem over the past several years. He was <br /> disappointed that the property owner was not in attendance to discuss this matter.He explained in order for <br /> this business to work,the owner of the property has to work with the tenants and this was not happening. He <br /> stated he has lived in his home since Tom purchased the property. He understood Tom has not been putting a <br /> lot of money into the property and the general upkeep has been rough.He indicated he wanted to make things <br /> work,but if the owner doesn't understand the rules,it would be tough to move forward. <br /> Mayor Niedfeldt-Thomas asked if the operators have the Special Use Permit,or the property owner. <br /> Assistant Director of Community Assets and Development Gozola reported the property owner holds the <br /> SUP. City Attorney Somalia clarified the SUP runs with the property. <br /> Councilmember Dunsworth clarified that the Council was addressing the violations to the SUP and not the <br /> condition of the building. She noted separate complaints would have to be filed through code enforcement <br /> staff to address those concerns.Assistant Director of Community Assets and Development Gozola reported <br /> this was the case,but noted the Council could direct staff to address the garbage and site concerns. <br />
