October 12,2021 Page 4 of 9 <br /> Mayor Niedfeldt-Thomas stated the owner was still responsible because he was the vehicle for the property <br /> having an SUP. City Attorney Sonsalla commented this was the case because ultimately the operations on <br /> the property were the owner's responsibility. <br /> Councilmember Axberg questioned what it would mean for this business to be in compliance with the SUP <br /> and inquired why the Council should believe the business owners would comply now when previous <br /> attempts have failed. Mr.Cooker stated he was not aware of the SUP issues at first. However,he understood <br /> now and he was willing to take the right steps to assure his business was in compliance with the SUP. <br /> Councilmember Axberg commented on the hours of operation and asked what the intent was to ensure the <br /> business complied with City regulations.Mr.Cooker explained he had changed his security personnel and if <br /> he needed to be on site to ensure events ended in a timely manner,he would do this. Mr.Amosu stated he <br /> filled out the SUP application and his phone number was on the application.He wondered why the Public <br /> Safety Department was not calling him when there was a concern.He noted he would talk to his partner <br /> about the grass and building exterior because the property owner was not doing anything to maintain the site. <br /> Councilmember Allen questioned if sound buffering or noise mitigation could be done inside the building. <br /> Mr.Amosu discussed the renovations that had been completed on the inside if the building to better insulate <br /> the structure. He anticipated the main concerns were when people were entering and exiting the building <br /> through the back door. <br /> Councilmember Abdulle inquired if the business owners could find a way to keep the back door closed. Mr. <br /> Cooker stated he has thought about putting an alarm on this door to discourage people from using the rear <br /> door. <br /> Mayor Niedfeldt-Thomas requested further information regarding the violations that have occurred and the <br /> fact the business owners have not had a licensed bartender onsite during events. She questioned how the <br /> business owners would ensure this did not happen again in the future. Mr.Cooker stated he has been using <br /> Little Venetian for all of his events and before he can use another vendor,he would have to receive approval <br /> from the City of New Brighton.He explained he does not have a liquor license so this service is subcontracted <br /> to a vendor with a liquor license.Further discussion ensued regarding an event that was held where the <br /> bartender was late for an event. <br /> Councilmember Abdulle commented he has a background in City planning and he was really wrestling with <br /> this matter.He noted this business was located very closely to residential homes.He reported the Council and <br /> staff was being tasked with balancing the rights of residents to live peacefully with the rights of a business <br /> owner.He stated it was very unfortunate that the property owner was not in attendance to have a discussion <br /> with the City Council. He feared that this issue could not be resolved in an easy manner.He hoped that the <br /> Council would be able to work with the business operators to resolve the noise concerns. He also understood <br /> there were unresolved issues with the property owner. <br /> Councilmember Dunsworth stated she was going to have to respectfully disagree.She indicated she was not <br /> struggling with this matter.She explained there has been 26 violations in three years. She noted this has been <br /> plenty of warning and the business operators were on a first name basis with Officer Hamdorf.She requested <br /> the code violations(garbage,grass,building exterior,etc.)be looked into by staff and discussed with the <br /> property owner. She commented the business operators have been well aware of the complaints against their <br /> business and this was not the way to conduct a business in New Brighton.She stated for seven years the <br /> property had no problems,and the new owners have brought about the concerns.She indicated there has been <br /> years of warnings and these warnings have not been addressed.She asked if there had been any complaints <br /> on the property since September 10. Officer Hamdorf reported the property has had two events since <br /> September 10 and there were no complaints from either event. <br /> Councilmember Dunsworth stated this was great,but questioned why it took so long to heed the warnings <br /> from the City. He commented Greg stated himself that his name was on the application which meant he was <br /> responsible for the complaints that were coming in.She stated to her this was not a balance act anymore <br /> because the site has had too many violations and action had to be taken.She indicated she takes this very <br /> seriously because the adjacent residential taxpayers were also trying to experience the peaceful enjoyment of <br /> their property. <br /> Mayor Niedfeldt-Thomas asked how Public Safety approaches these types of complaints. Officer Hamdorf <br /> explained when events are planned a security plan is required. He noted he has a long standing relationship <br />
