He commented after the security plan is submitted,he communicates when the <br /> plans are approved through an email to the business owner.If calls are generated from the event,tickets are <br /> not generally issued,but those at the event are told to fix it He indicated many times concerns arise because <br /> the back door is ajar. He commented further on the alcohol sales violation that occurred on the property.He <br /> reported the department works to educate the public on violations in order to bring properties into compliance. <br /> Mayor Niedfeldt-Thomas asked if the City had any other special event SUP's. Assistant Director of <br /> Community Assets and Development Gozola stated not any that he was aware of,except for the New <br /> Brighton Community Center. <br /> Councilmember Abdulle questioned if the calls were coming from numerous people in the community or <br /> was the same person making complaints.Officer Hamdorf reported this was confidential information that he <br /> could not share with the public. <br /> Councilmember Abdulle commented this property had become clearly become a concern but noted he was <br /> willing to give them one more chance. He stated there may have been a lack of understanding as to what the <br /> City's requirements were and he appreciated how the City had been trying to work with the business owners. <br /> He encouraged the City Council to give these gentleman one more chance. <br /> Mayor Niedfeldt-Thomas inquired what liability the City would take on by not revoking the SUP,given the <br /> number of complaints this property has had. City Attorney Sonsalla stated there was no additional liability to <br /> the City giving the business owners another chance. <br /> Councilmember Allen anticipated that in order for this to work the property owner would have to be <br /> involved.He indicated it was disappointing that he was not in attendance.He stated without his willingness to <br /> work on the property,he did not see how this business would work. <br /> Councilmember Abdulle questioned what the City can do to address the trash and site concerns.Assistant <br /> Director of Community Assets and Development Gozola reported he would take the Council's direction as <br /> an official complaint and would look into the landscaping,grass and garbage concerns on this property. <br /> Councilmember Axberg asked how the business owners would be acting going forward versus how they <br /> have acted in the past when receiving complaints from the City.Mr.Amosu explained he has not received <br /> complaints in the past and anticipated these letters went to the property owner. <br /> Councilmember Dunsworth stated regardless of this,the business owners were aware of the conditions that <br /> must be followed in order to operate an SUP from this property. She questioned if certain groups were <br /> leading to louder events at the Mirage.Mr.Amosu stated this would depend on the size of the party. <br /> Councilmember Dunsworth reiterated that the City has tried to work with the business owners for the past <br /> three years and this was not working. She indicated this was not something the Council wanted to happen in <br /> New Brighton. <br /> Mr.Cooker asked if the COVID restrictions have relaxed enough that the New Brighton Public Safety <br /> Department would be available to provide security for his events.Officer Hamdorf commented the <br /> responsibility to ensure the events were closing at 12:30 a.m.or 1:00 a.m.and that the back door remained <br /> close fell to the business owners and not the Public Safety Department or other hired security personnel. He <br /> explained the business owners have to follow the rules within the SUP and stated he could not commit his <br /> officers to providing security for every event on this property. <br /> Mayor Niedfeldt-Thomas stated she has worked with many entrepreneurs and small business owners.She <br /> was thankful that these gentlemen want to run a business in New Brighton.She anticipated the original <br /> business plan has altered over time and encouraged the business owners to consider what type of shift has <br /> occurred. She reported the SUP has not altered and the business owners would still have to comply with <br /> these guidelines.She encouraged the business owners to be onsite to ensure all site safety procedures were <br /> being followed. <br /> Councilmember Abdulle stated the Mayor was getting to the points he was trying to make.He believed the <br /> City and its staff was very reasonable in trying to work with business owners in the community.He was of the <br /> opinion the business owners should be given a second chance,but asked if the business owners understood <br /> the rules. Mr.Cooker stated he understood the rules. Mr.Amosu indicated he understood and he would be <br /> following through. <br /> Councilmember Allen questioned if the SUP was revoked,could the applicants reapply. City Attorney <br />
