Consider Resolution Adopting ADA Transition Plan for Public Rights of Way <br />City Manager Massopust indicated Engineer Dustin Lind would be presenting this item to the Council. <br />Engineer Lind introduced the item and stated Gus Perrin with WSB had a presentation for the City Council. <br />Gus Perrin, WSB, explained the Americans with Disabilities Act (ADA), enacted on July 26, 1990, <br />'is a civil rights law prohibiting discrimination against individuals on the basis of disability. The <br />purpose for an ADA compliance plan was discussed along with the seven steps to compliance. <br />It was noted ADA consists of five titles outlining protections in the following areas: <br />Employment, State and local government services, Public accommodations, <br />Telecommunications, and Miscellaneous provisions. As a provider of public transportation <br />services and programs, the City of New Brighton must comply with Title Il of the Act as it <br />specifically applies to public service agencies. To satisfy the requirements of Title 11, the City <br />hired WSB to perform an evaluation of all existing City owned and maintained facilities <br />(sidewalks, bituminous trails, pedestrian curb ramps) within public rights of way. WSB also <br />developed the required Transition Plan detailing the evaluation findings and outlining how the <br />City will continue to ensure that all facilities are accessible to all individuals. The Transition <br />Plan also includes cost estimates for the improvements needed to bring the City into full <br />compliance over time. The cost estimates provided will be incorporated into future Capital <br />Improvement Projects, as facilities will be reconstructed when adjacent to street improvement <br />projects. Mr. Perrin commented further on the proposed plan, noting the inventory and <br />implementation plan and recommended approval. <br />Councilmember Axberg asked if New Brighton residents have raised any concerns or <br />grievances. Mr. Perrin reported through the public input period there no public feedback or <br />grievances were submitted. <br />Mayor Niedfeldt-Thomas questioned if the plan being approved by the Council would bring <br />the City into 80% or 90% compliance. Mr. Lind reported the updated plan would bring the City <br />into 90% compliance. <br />'Councilmember Abdulle explained he was happy to see the City had an ADA compliance plan <br />in place and that the City would be moving from 29% to 90% compliance over the next 20 <br />years. He inquired what was being done to make streets without sidewalks ADA accessible or <br />multimodal. Community Assets and Development Director Schlichting reported this was <br />outside the scope of this study. He stated sidewalk systems were not in place on all City streets. <br />He indicated staff was discussing a complete street policy that would outline some of the <br />3.
