REQUEST FOR COUNCIL CONSIDERATION
ITEM DESCRIPTION: Consider Approval of Easement Updates for City Project 19‐12, MCES Interceptor
and 694 Sewer Crossing.
DEPARTMENT HEAD’S APPROVAL: Craig Schlichting, Director of Community Assets and Development
CITY MANAGER’S APPROVAL:
No comments to supplement this report ___ Comments attached ___
Recommendation: To approve and accept the attached updated easement agreements:
1.Memorandum of Agreement
2.Temporary Access Easement
3.Temporary Construction Easement
Legislative History: These easements were reviewed and approved by the City Attorney, Metropolitan
Council and LVP, LLC (Owner).
Strategic Priority Alignment: Sustainable and Reliable Infrastructure
Financial Impact: The City will pay for the easements, appraisal fees, and future lining costs
Explanation: The Metropolitan Council is currently in the final phases of the Long Lake Interceptor
Improvement Project. This project will structurally line regional sewer services on the south side of
Long Lake. Sewer from a large portion of southern New Brighton discharges into the regional pipes via a
sewer pipe under TH 694. During construction it will be necessary for the Met Council to bypass pump
New Brighton sewer around their project. The City will take advantage of this bypass pumping to
structurally line our pipe below 694, which was found to be structurally deficient during recent
televising inspections. In doing so, the City will avoid the costs of bypass pumping and plan
design/bidding services that are being provided by the Met Council. To initiate the City portion of the
project the City worked with Lakeview Apartments for easements.
Due to unanticipated delays with the bidding process, the Project has been delayed so that construction
will occur between November of 2022 and June of 2023 instead of between November of 2021 and
June of 2022. With this delay the dates of the easements needed to change.
Costs and Funding: The City purchased the temporary easements for $8,300 (the market value
established in an appraisal report by Patchin Messner). These costs were paid for by Fund 702, Sewer
Improvement Fund.
___________________________________
Craig G.
