Falsely reporting violations. 369 <br />No person shall report a violation of this Article knowing or having reason to know that the report is false with the 370 <br />intent to affect the licensing status or inspection schedule of the rental dwelling. 371 <br />Sec. 13-163. Violations. 372 <br />In addition to any other sanctions or administrative penalties imposed, any violation of this Article shall constitute 373 <br />a misdemeanor offense, punishable as defined by state law. Each day of violation constitutes a separate offense. 374 <br />Sec. 13-164. Rules, policies, and procedures. 375 <br />By resolution the City Council may adopt, from time to time, rules, policies, and procedures for the 376 <br />implementation of this chapter. Violation of any such rule, policy, or procedure by a property owner shall be 377 <br />considered a violation of this article. 378 <br />Section 13-165. Provisional License – Three or More Units 379 <br />(1) Trigger. Any rental license authorizing rental of three or more units that generates an average of more than 380 <br />0.5 police or fire calls per dwelling unit over a consecutive six month period as specified in this Section 381 <br />shall be transitioned to provisional license status in order to maintain licensure. 382 <br />(A) Police and fire calls that contribute to the triggering of provisional license status include the following 383 <br />types of calls or events: 384 <br />1. Violations which indicate the rental constitutes a disorderly premises. A premises is disorderly 385 <br />when any of the following activities occur: 386 <br />a. Violation of laws relating to the possession of controlled substances as defined in Minnesota 387 <br />Statutes Section 152.01, Subdivision 4. 388 <br />b. Violation of Section 18-3 (Disorderly Conduct) of the City Code or Minnesota Statutes, 389 <br />Section 609.72. 390 <br />c. The unlawful sale of intoxicating liquor or 3.2 percent malt liquor. 391 <br />d. Violation of laws relating to gambling. 392 <br />e. Violation of laws relating to prostitution as defined in Minnesota Statutes, Section 609.321, 393 <br />Subdivision 9, or acts relating to prostitution. 394 <br />f. Unlawful use or possession of a firearm or weapon in violation of Chapter 18, Article 2 of the 395 <br />city Code or Minnesota Statutes, Section 609.66, Subdivision la, 609.67 or 624.713. 396 <br />g. Violation of Section 18-2 of the City Code (Threatening a Public Officer). 397 <br />h. Violation of Minnesota Statutes, Section 609.705 (Unlawful Assembly). 398 <br />i. Violation of Minnesota Statutes, Section 609.71 (Riot). 399 <br />j. Violation of Minnesota Statutes, Section 609.713 (Terrorist Threat). 400 <br />k. Violation of Minnesota Statutes, Section 609.715 (Presence at Unlawful Assembly). 401 <br />2. Calls or events categorized as part one crimes in the Uniform Crime Reporting System, including 402 <br />homicide, rape, robbery, aggravated assault, burglary, theft, auto theft and arson. 403
