<br /> <br />Ordinance No. 892 <br />Residential Licensing Requirements <br />7/8/22 <br /> <br /> <br />Page 15 of 21 <br />(C) A mitigation plan indicating how the license will be brought out of provisional status. The mitigation 438 <br />plan shall describe steps proposed by the applicant to reduce the number of qualifying police and fire 439 <br />calls to a level that qualifies for a regular license. The mitigation plan may include but is not limited to 440 <br />actions amending tenant screening procedures, changes in lease terms, addition of security measures, 441 <br />adoption of rules and regulations for tenant conduct, and hiring of security personnel. 442 <br />(D) The required provisional licensing fee as established by the city's fee schedule. 443 <br />(4) Review by the City Council. The provisional license application and proposed mitigation plan shall be 444 <br />presented to the City Council together with a disposition recommendation by the City Manager following 445 <br />notice and hearing requirements outlined in Section 13-168. After giving the applicant an opportunity to be 446 <br />heard and present evidence, the City Council shall approve, approve with conditions, or deny the 447 <br />provisional license application and mitigation plan. If the City Council denies the provisional license or 448 <br />approves it with conditions, it shall state its reasons for so doing in writing via resolution that day or at a 449 <br />subsequent meeting. Denial of a requested provisional license may immediately allow Council to proceed 450 <br />to revocation or suspension of the rental license subject to the provisions of Section 13-168 without the 451 <br />need for an additional hearing. 452 <br />(5) Provisional License Requirements. In addition to implementing the details of an approved mitigation plan, 453 <br />the following standards shall also be met by all provisional license holders: 454 <br />(A) Monthly Reports. No later than the tenth day after each calendar month, the licensee shall mail or 455 <br />deliver to the City a written report describing all steps taken in furtherance of the mitigation plan during 456 <br />the preceding month. 457 <br />(B) Manager Certification. The applicant must provide and maintain at least one resident manager or on-458 <br />site manager(s) who are on-site or available 24-hours a day who successfully complete a training 459 <br />program provided by the City or specified by the City. A provisional license may be granted to an 460 <br />applicant who does not currently have a certified resident or on site manager, and a license may 461 <br />continue in effect following the departure of a certified resident manager, provided the resident 462 <br />manager or on site manager shall register for and complete the training program within a timeframe as 463 <br />agreed to with the Department of Public Safety. 464 <br />(6) Enforcement of Provisional License Violations. The City Manager shall be responsible for enforcement and 465 <br />administration of Provisional Licenses. Authority to take any action authorized by this subsection may be 466 <br />delegated by the City Manager to an authorized designee. 467 <br />(A) Notice of Violation. Upon determination by the City that a provisionally licensed premises experiences 468 <br />triggering events as identified in Section 13-158(1) during provisional status, notice of the violation(s) 469 <br />shall be given to the licensee. The notice shall include a directive for the licensee to take steps to 470 <br />prevent further violations, and may include agreed upon amendments to the mitigation plan to further 471 <br />address all areas of concern. 472
