Policy Directive (DRAFT) <br />Residential Rental Property Inspection Policy <br /> <br /> <br />To: DCAD <br />From: Devin Massopust, City Manager <br />Effective Date: xx-xx-22 <br /> <br /> <br />POLICY OVERVIEW <br />On xx-xx-xx, the City Council of the City of New Brighton approved Ordinance 892 which updates the City’s approach <br />to regulating residential rental properties throughout the City. Renting homes to our residents is an important <br />business enterprise that must be done responsibly and in a manner that does not lead to crime, blight, or the <br />disruption of our neighborhoods. The purpose of this policy is to establish an inspection schedule that holds all <br />residential rental business owners to a consistently high standard, and to ensure that rental properties are good <br />neighbors that provide safe living options for our residents <br />Standards set in this policy are the minimum standards that must be maintained by all residential rental properties. <br />When the minimum standards are not maintained, the City of New Brighton may take any enforcement action <br />authorized by the City’s Rental Licensing Ordinance (Chapter 13, Article 3), and/or by any other local, State, or <br />Federal Law. <br />Inspection Schedule <br />Residential rental property will be regularly inspected by one or more members of the City’s rental inspection team. <br />The frequency of required inspections shall be based on the number of units requested for licensure, or on an <br />Inspection Point System in the case of single-family and duplexes. Regardless of the required inspection schedule, <br />the City may inspect a residential rental property off-schedule for any of the following reasons: <br />(A) The property taxes on the residential rental property are delinquent and a proper challenge to the property <br />taxes has not been filed. <br />(B) A member of the City’s rental inspection team has determined that the property has building code or <br />property maintenance violations that did not exist during the last required inspection, and such issues <br />reasonably warrant an inspection of the unit(s) in a timely manner. <br />(C) The property has been sold or the ownership interest in the property has been transferred. <br />(D) The property is being rented without a valid rental license. <br />(E) The property has an excessive number of police calls and is in (or may soon be in) provisional license status.
