Page 2 of 3 <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested Planned Residential Development Amendment based on the <br />following findings of fact: <br />1. The subject property is guided for Low Density Residential use by the 2040 Comprehensive <br />Plan, and R-1 zoning standards are consistent with this land use classification; <br />2. The subject land was approved as a Planned Residential Development as Silver Oak Estates <br />No. 2 in 1973, and has developed in accordance with the original approval since that time; <br />3. Approval of Silver Oak Estates No. 6 will have no impact on the arrangement or number of <br />allowed units on the property as originally authorized by Silver Oak Estates No. 2. <br />4. The new proposed lot line location for the home at 3024 18th Avenue NW will result in <br />existing structures meeting minimum setbacks required by the underlying R-1 zoning <br />designation. <br />5. The new lot area and configuration for 3024 18th Avenue NW, while smaller than typically <br />required by R-1 zoning, may be authorized as part of a Planned Residential Development <br />and is therefore appropriate. <br />6. The proposed amendment to the Planned Residential Development will have no impact on <br />utilities or roadways servicing the development. <br />7. Easement issues identified by legal counsel in the plat opinion can be addressed prior to <br />execution of the new final plat. <br />BE IT FURTHER RESOLVED, that approval of the requested Planned Residential Development <br />Amendment shall be subject to the following conditions: <br />1. Prior to the City signing the final plat, all issues identified in the plat opinion letter prepared <br />by Kennedy & Graven dated March 16th, 2023, shall be successfully addressed to the <br />satisfaction of the City Attorney. <br />2. The applicant shall have the final plat reviewed by Ramsey County for needed changes prior <br />to production of final mylars for signature. Changes requested by Ramsey County can be <br />administratively approved by staff <br />3. Reference monuments shall be placed in the subdivision as required by state law.. <br /> <br /> <br /> <br /> <br /> <br />
