The fee owner’s acknowledgment with respect to Silver Oak Estates No. 2 <br />Association should be revised to insert the State and County designation before the <br />acknowledgment. For example: <br /> <br />STATE OF MINNESOTA <br />COUNTY OF ___________________ <br /> <br />In witness whereof said Silver Oak Estates <br /> <br />I require review of this revision. <br /> <br />d. The fee owner’s acknowledgement should be revised from “as ___________ of <br />Silver Oak Estates” to “____________, of Silver Oak Estates”. I require review of <br />this revision. <br /> <br />e. The surveyor’s certificate should be revised from: “depicted on this plat have been <br />correctly set or will be correctly set within one year of recording this plat;” to “that <br />all monuments depicted on this plat have been correctly set; that all monuments <br />indicated on this plat will be correctly set within one year;”. I require review of <br />this revision. <br /> <br />f. The County Recorder certification should be revised to “Book ____ of Plats, Page <br />_____,”. Terms and conditions of Declaration of Covenants, Conditions and Restrictions, <br />dated November 5, 1973, filed November 14, 1973, as Document No. 1870704 (Lot <br />19); amended by First Amendment to Declaration of Covenants, Conditions and <br />Restrictions to Modify the Real Property Governed by the Declaration of <br />Covenants, Conditions, and Restrictions Silver Oak Estates No. 2., filed November <br />16, 2012, as Document No. 43369168 (releasing Lots 1 and 2, Block 1 of Silver <br />Oaks Estates No. 2 from Declaration). <br /> <br />The Declaration defines Lot 19, Block 1 of Silver Oaks Estates No. 2 as “The <br />Common Area” and not as a “Lot” under the Declaration. Each owner of Lots 1 - <br />18, Block 1 of Silver Oaks Estates No. 2 has an “easement of enjoyment” in Lot 19 <br />of the Property. This private easement need not be depicted on the Plat. A search <br />of County Property records for Document No. 43369168 does not return a <br />document related to the Property.
