Page 1 of 3 <br /> <br />RESOLUTION __________ <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />AND SITE PLAN TO ALLOW AN ADDITION ONTO THE EXISTING LEGAL <br />NONCONFORMING BUILDING AT 2201 26TH AVENUE NW <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, Appletree Dental owns the property at 2201 26th Avenue NW which is legally <br />described as: <br /> <br /> <br /> <br /> <br /> <br />WHEREAS, the property at 2201 26th Avenue NW was recently rezoned to Mixed Use <br />Neighborhood, and the existing building on the property is legal nonconforming to the standards of <br />the new district; and <br /> <br />WHEREAS, mixed use district regulations allow for expansion of legal nonconforming buildings <br />via a special use permit provided the proposed plans adhere to the new zoning standards to the <br />greatest degree practical; and <br /> <br />WHEREAS, Appletree Dental filed an application seeking a special use permit and site plan to <br />authorize construction of a new garage addition to the north of the building and expansion of the <br />existing parking lot; and <br /> <br />WHEREAS, the garage addition and parking lot expansion will meet all setbacks and design <br />standards required for such features; and <br /> <br />WHEREAS, the applicants will be installing required landscaping and screening to both meet <br />required standards and to adhere to the new zoning standards to the greatest degree practical given <br />the context of the existing features; and <br /> <br />
