General Conditions 8 <br /> 9 <br />Sec. 11-010. General Requirements. 10 <br /> 11 <br />(1) Application. Off-street parking and loading regulations shall apply to all buildings and land uses 12 <br />established after December 1331, 19882023. 13 <br />A. At the time an existing land use or building use changes, a building expands, or an existing 14 <br />parking lot expands or is alteredproperty is redeveloped where cumulatively half the property 15 <br />area or more is altered, or an existing parking lot expands, the developer and/or property owner 16 <br />shall work with the Department of Community Assets and Development to bring existing and any 17 <br />required additional off-street parking and loading areas into conformance with the regulations of 18 <br />this Chapter. 19 <br />B. In the event a property owner is expanding parking through existing parking areas or to 20 <br />decrease an existing nonconformity, regulations from this chapter may be waived, subject to 21 <br />review and approval of the Department of Community Assets and Development. 22 <br />C. In the event a building or property shifts from a non-residential use to a residential use, or a 23 <br />residential use requiring fewer spaces shifts to a residential use requiring more spaces, the 24 <br />property owner or developer must provide additional spaces to make up the difference. 25 <br />existing and any required additional off-street parking and loading areas must be brought into 26 <br />conformance with the regulations of this Chapter, subject to the provisions of Sections 8-410 through 8-27 <br />480. 28 <br />(2) Purpose. Off-street parking and loading regulations are a part of the city’s charge to protect the 29 <br />health, safety, and welfare of residents and visitors. In addition, the city has off-street parking and loading 30 <br />standards to promote beneficial and sustainable systems to: 31 <br />A. Improve drainage flow and infiltration opportunities to reduce non-point source pollutants, 32 <br />including chlorides; 33 <br />B. Reduce heat-island effects at the local scale; 34 <br />C. Promote alternative modes of transportation and connectivity to local and regional trail 35 <br />systems (transit, ride-share, bicycle/scooter, etc.); 36 <br />D. Increase availability of EV charging stations and proximity to facility entrances; 37 <br />E. Provide surmountable curb for wildlife migration and improved lighting that complies with 38 <br />dark-sky guidelines 39 <br />F. Improves accessibility and safety through improved line-of-sight and reduced issues due to 40 <br />winter freeze-thaw events 41 <br /> 42 <br />(32) Required Plan. Except for single and two family residences, all applications for a building permit or 43 <br />for a certificate of occupancy shall include a site plan drawn to scale and dimensioned indicating the 44 <br />location of off-street parking and loading spaces in compliance with this Chapter. 45 <br /> 46 <br />(43) Reduction and Use of Parking or Loading Space.
