<br /> <br />2 <br /> <br />V. Report from City Council Liaison <br />Mayor Niedfeldt-Thomas provided the Commission with an update from the City Council. She <br />thanked the Planning Commission members for attending the recent joint meeting with the City <br />Council to discuss parking standards in the community. She reported the Council approved a <br />purchase agreement with United Properties for the Block B property within the New Brighton <br />Exchange. She noted the Council also approved a contract with Kraus Anderson for the <br />improvements at Totem Pole Park. She indicated the Council has completed and was in the process <br />of reviewing a housing study. She commented further on the work the City was doing with Just Deeds <br />to address racial covenants. <br />VI. VI. Public Hearing <br />(A) Special Use Permit & Site Plan Review: Request from Appletree Dental at 2201 26th Avenue <br />NW to expand on-site parking and place an addition on a legal nonconforming building in the <br />Mixed Use Neighborhood (MUN) District; PID: 18-30-23-24-0052. <br />Assistant Director of Community Assets and Development Gozola reported Apple Tree Dental is <br />seeking to remodel the building at 2201 26th Avenue NW to house their corporate offices, lab, <br />and mobile unit operation. The remodel will include the addition of a garage to the north of the <br />existing legal nonconforming building, and expansion of the on-site parking lot. The right of way <br />concerns on this property were discussed at length and it was noted the City would be <br />addressing this matter. Staff provided further comment on the request and recommended <br />approval of the Special Use Permit and Site Plan Review, based on the findings of fact and <br />subject to the following conditions: <br />1. The applicants shall address all engineering issues listed in the 6/15/2023 Engineering <br />memo to the satisfaction of the City Engineer. <br />2. Material used on the proposed building addition shall match or complement the materials <br />on the existing building. <br />3. The applicant shall work with the City Forester to select the species and size of trees and <br />shrubs to be used to implement required screening (Option A) along the property’s north <br />boarder. Screening to be expanded as needed to address any loss of existing vegetation. <br />4. Prior to issuance of a certificate of occupancy, a fire protection engineer shall be hired by <br />the applicant to determine if the new commodity matches the sprinkler density of the <br />building. Work of the fire protection engineer shall be coordinated with the local Fire <br />Marshal. <br />5. The applicant shall be required to correct any lighting problems that are identified <br />following construction. <br />6. Failure to adhere to these conditions of approval shall be grounds for revocation of the <br />special use permit amendment by the City Council.
