1 <br />NE136-36-895631.v2 <br />LEASE AGREEMENT <br />THIS LEASE AGREEMENT (this “Lease”), made and entered into as of this __________ <br />day of ______________, 2023, by and between the City of New Brighton, a Minnesota municipal <br />corporation, whose address is 803 Old Highway Eight Northwest, New Brighton, Minnesota 55112 <br />(hereinafter referred to as “Landlord”) and Rise, a Minnesota nonprofit 501(c)(3) organization <br />which supports people who have disabilities and other barriers to employment and housing whose <br />address is 8406 Sunset Road N.E, Spring Lake Park, MN, 55432-1387, (hereinafter referred to as <br />“Tenant”.) <br />WITNESSETH: <br />ARTICLE I - GRANT AND TERM <br />1.1 LEASED SPACE. In consideration of the rents, covenants and agreements herein <br />reserved and contained as the part of Tenant to be performed, Landlord does hereby lease to Tenant <br />Room 208 (approximately 897.75 square feet), Room 209 (approximately 866.5 square feet), <br />Room 210 (approximately 482.7 square feet), and Room 212 (approximately 440.7 square feet) in <br />the New Brighton Community Center located at 400 Tenth Street Northwest, New Brighton, <br />Minnesota, hereto (hereinafter referred to as the “Leased Space”.) A drawing of the Leased Space <br />is attached hereto as Attachment One. <br />1.2 TERM. The term of this Lease and Tenant’s obligation to pay rent hereunder shall <br />commence on September 10, 2023, (“Commencement Date”) and shall run until September 9, <br />2028 (“Term”). Either party may terminate this Lease early for any reason if a 90 day written <br />notice is provided to the other party. <br />1.3 USE OF COMMON AREAS. Tenant shall have the non-exclusive right to use the <br />entry ways, elevators, stairs, hallways, and restrooms of the Community Center. Employees of <br />Tenant shall have the non-exclusive right to use the Community Center parking areas. No more <br />than six guests or invitees of Tenant shall be permitted to use the Community Center parking areas <br />except by approval of Landlord. In addition, Tenant will be assigned parking spaces in the <br />Community Center parking lot for its five, passenger vans and one bus. Tenant’s use of the public <br />areas of the Community Center shall be subject to such reasonable rules and regulations for use of <br />such areas as may be established from time to time by Landlord. <br />1.4 ACCESS TO COMMUNITY CENTER. Tenant, its employees and invitees shall <br />have access to the Community Center during normal business hours. These hours are currently <br />Monday-Friday from 6:00 a.m.-10:00 p.m. There shall be no access to the Community Center <br />during non-business hours by Tenant or its employees or invitees. There shall be no access to <br />Tenant or its employees or invitees on Easter Sunday, Memorial Day, Independence Day, Labor <br />Day, Thanksgiving, Christmas Eve Day, or Christmas Day. The Community Center may have <br />limited hours on other dates throughout the year where Tenant shall not have access, including but <br />not limited to, New Years’ Eve Day, and New Years’ Day. Tenant will be provided five keys for <br />access to the Leased Space. Tenant shall make no more keys than are provided by Landlord. If <br />Tenant loses any of the keys that were provided by Landlord, Tenant will be charged $50 per key <br />lost and $50 per lock that will need to be rekeyed.
