2 <br />NE136-36-895631.v2 <br /> <br />Landlord shuts down the Community Center each year for a period of four to 10 consecutive days <br />for cleaning, repair, and renovation. Tenant will be given no less than 30 days’ notice of this event. <br />During this period, Tenant’s employees may still operate within the Leased Space and Tenant’s <br />invitees may have access to the Leased Space if accompanied at all times by Tenant’s staff. <br /> <br />In some years (but no more often than every other year, except in the event of an emergency or <br />casualty), the Community Center will be closed by Landlord for safety reasons for up to five days <br />during which time Tenant’s employees and invitees may not have access to the Leased Space. <br />Tenant will be given no less than 120 days’ notice of this event unless the closure occurs due to an <br />emergency or casualty. <br /> <br />ARTICLE II - RENT <br /> <br />2.1 RENT. If the Lease Term as stated above commences on a day other than <br />the first day of a calendar month or ends on a day other than the last day of a calendar month, the <br />rent for such first or last fractional month shall be such proportion of the monthly rent as the <br />number of days in such fractional month bears to the total number of days in the calendar month. <br /> <br />2.2 ADDITIONAL RENT. All other charges to be paid by Tenant pursuant to the <br />provisions of Article V of this Lease shall be designated as “Additional Rent.” Subject to the <br />provisions of Section 9.1 of this Lease, failure of Tenant to pay “Additional Rent” shall give <br />Landlord the right to declare an event of default. Landlord will provide invoices for Additional <br />Rent to Tenant at the conclusion of each calendar year quarter during the Term of this Lease. <br /> <br />2.3 RENT DELINQUENCIES. The provisions of Minnesota Statutes Section 471.425 <br />shall govern interest accrual and disputes regarding payment. <br /> <br />2.4 TAXES, ASSESSMENTS, AND OTHER CHARGES.
